Why Was Sarah Herlihy Worrying About Article II?

Contrairimairi has forwarded a post from Insight Analytical concerning Sarah Herlihy's article that was also discussed in the blog Count us Out. Someone had forwarded Herlihy's article to me and I blogged it on November 29. Herlihy works for the law firm of Kirkland and Ellis out of their Chicago office. The kicker is that Herlihy's article was published in the Kent Law review in 2006 and, notes Count us Out Blogger Creative Ogre:

"While digging my way through the Internet last night, I came across the following paper, written by SARAH P. HERLIHY. It’s title: AMENDING THE NATURAL BORN CITIZEN REQUIREMENT: GLOBALIZATION AS THE IMPETUS AND THE OBSTACLE caught my eye, and had to read it…

"I had to ask myself, what would drive any American to want to change a clause in a document that is the very foundation of our government? So, I kept digging, and found that SARAH P. HERLIHY is employed by Kirkland & Ellis LLP

"Noting that this law firm is based in Chicago, the light bulb was shining a little brighter . Upon looking at the firm, and the partners, I found that Bruce I. Ettelson, P.C., is Member of finance committees of U.S. Senators Barack Obama and Richard Durbin.

"In addition, Jack S. Levin, P.C., another partner who, in December 2002 was presented the ” Illinois Venture Capital As sociation’s lifetime achievement award for service to the private equity/venture capital community” presented by Sen. Barack Obama

"So it sure looks like Obama’s people have looked into the matter of “Natural born” as far back as early 2006. What is even more disturbing is that it would appear that they are following the thought of "If the facts do not support the theory, Destroy the facts!”

Here is the introduction to the paper… It looks like a road map for Obama’s defense lawyers…And a precursor to a Socialist world."

It shows that nobody now claiming that this is a clear and indisputable fact had any inkling of it before Obama was elected.
You're amazing! You're able to follow people around the Internet wherever they go whenever they went! I mean, you seem to know that nobody went to another site and discussed it there or talked about it in an e-mail or even discussed it via FReeper mail.

So even though every new birther theory gets aired instantly across multiple threads, this particular one just happened to be shared through private correspondences until after Obama was elected. Oh yes, that makes total sense.

It was kind of like the few brave individuals who started talking about the North American Union here on FR who were roundly criticized and ridiculed. It worked wonders. Nobody wants to postulate anything outside of the norm any more. And now several years down the line vindication comes as Wikileaks showed.

I can search the web based on specific dates, and I'm not seeing anyone talking about this until late in 2008. Not here, not anywhere.

Unlike the private emails, this should be easy to prove; all you have to do is post the sites you're talking about.

I think I see where our newly self-appointed monitor is going. If no one was discussing Vattel prior to a date certain then Vattel must be ignored. It’s like the speed limit in my town. The driver’s ed book the highway and safety department hands out for taking the TN driver’s license exam states that unless posted, the speed limit in town is 30mph; barry the bastard’s defenders read that as unless a speed limit is posted, there is no speed limit, especially if you’re not caught doing 80 mph through town.

Clearly, the custom of granting automatic citizenship at birth to children of tourists and temporary workers such as Hamdi and to countless "anchor babies" delivered by illegal aliens on American soil, undermines the integrity of citizenship – not to mention national security. Originally intended to ensure the citizenship rights of newly freed slaves and their families after the Civil War, the citizenship clause has evolved into a magnet for alien lawbreakers and a shield for terrorist infiltrators and enemy combatants.
If the courts refuse to close the birthright citizenship loopholes, Congress must. Citizenship is too precious to squander on accidental Americans in Name Only.

That means you have to seek out Fuller's dissent.
Before the Revolution, the view of the publicists had been thus put by Vattel:
The natives, or natural-born citizens, are those born in the country of parents who are citizens. As the society cannot exist and perpetuate itself otherwise than by the children of the citizens, those children naturally follow the condition of their fathers, and succeed to all their rights.

Vattel was being discussed, only under the aspects of anchor babies, not presidential eligibility, even though it applies to that issue as well.
