Righthaven loses second fair use ruling over copyright lawsuits

An Oregon nonprofit did not infringe on copyrights when it posted without authorization an entire Las Vegas Review-Journal story on its website, a judge ruled Friday.

U.S. District Judge James Mahan said during a hearing he planned to dismiss, on fair use grounds, a copyright infringement lawsuit filed against the Center for Intercultural Organizing (CIO), in Portland, Ore.

The lawsuit was filed last year by Righthaven LLC of Las Vegas, the Review-Journal's copyright enforcement partner that also enforces copyrights for the Denver Post.

Righthaven needs to be made to stop this frivolous BS.

What they are suing for is not CW infringement. Its them trying to pop small fish and earn a fast $5,000 here and there in settlements. Nothing more....

Just like the music folks suing parents over their kids sharing 5, 10 20 songs... demanding millions then settling for $1,000 a song payable to them in monthly installments, its BS.

Now if the LA Times is reposting their articles without credit that’s different, but bloggers and even posting here on FR it should be understood its not CW infringement. Also as a source link is posted with it, like here at FR.

This is how I think these evil SOB’s work. They try to bully people into a $10K settlement and to give up their web site.

Well these mega POS - recently lost a hearing where they tried to get the judge to not award legal fees to defendants if Righthaven lost. So if they lose a case - in most cases the defandant will get their legal fees back.

Righthaven said one defendant was running up their legal fees as a strategy to really stick it to Righthaven at the end of the case. For that mentality - they 1. Want people to settle. 2. They know they are on shaky legal ground.

Evil scum.

You can bet that Judges were - and still are - getting “a piece of the action”

All over the USA there are hotshot attorneys (one I once knew locally just got a year and a day for income tax evasion!), physicians (In FL recently - Medicare fraud for Lamborghinis !!!), politicians (CA esp.), Judges, etc. getting away with huge tax-free criminal scams and schemes

“Writing” books they cannot write - with say - $2.5 million income - while they want a top surgeon to be limited to $100,000 a year (my Doc laughed bigtime)

Yes, I wrote in another post that I didn’t trust any of them, etc, etc. They are all crooks.

One long time lawyer in my town just went to jail. I knew someone who had used him and liked him.

Yes good news...lets hope now that websites and blogs do not back down to Righthaven anymore...since they are now losing legal rulings

Most courts and judges around the country do not like it when a case is brought to court, and no attempt to remedy the issue out of court has been made. Righthaven had better wise up

Lots of attorneys (including many paid as experts by certain cable and network channels) prefer to be paid in cash

How and why they could not comprehend they could be caught - and why they would consider taking the huge risk - I dunno

Oh - That type is often quite professional and wins in court - and often has a resume including working as or with local prosecutors and Judges

One well know attorney represented a Kennedy cousin in a big murder “cold-case”
