But not for long. In case you have not noticed, all of the success that the pro-gay marriage movement has had is a result of Federal Courts applying recent equal protection jurisprudence to state law, and in some cases state constitutional provisions. Via the commerce clause, the definition of what is a part of "interstate commerce" has been expanded to the point that there is nearly nothing that is not reachable on commerce clause grounds. So, enjoy this seeming victory while you can, the forces that brought you gay marriage in many parts, soon to be all, of the country, are tenacious and sophisticated in their legal strategies, and eventually they will get around to relative minutiae like this wedding chapel. As I have posted ad nauseum, the only thing that would stop gay marriage would be a Federal Constitutional Amendment prohibiting it, or at least excluding state restrictions on marriage from the reach of equal protection. That is not very likely as a political matter, especially since you see no one working on that at present.

Appoint jurists to the SCOTUS that demonstrate a thorough understanding of enumerated powers. Problem solved.

Ted Cruz has announced he will be proposing a Constitutional Amendment concerning this.
