ANOTHER VERY STUPID LAW
Fiedor Report On the News #305 ^ | 3-9-03 | Doug Fiedor

Posted on 03/08/2003 9:59:12 AM PST by forest

A woman was arrested at an airport for "possession" of an illegal substance. That's nothing new; except that this woman did not do anything wrong.

A stupid federal law states that it is illegal to transport prescription drugs out of the container provided by the pharmacist. Never mind that every drug store in the country sells special containers for just that purpose; under federal law, it is a felony.

Compliance with the intent of the law would mean that every person on medication(s) must box up the complete bottles of every medication they will need during every outing. That is foolish, of course. No one does that.

However, because of that stupid law, Congress has made nearly every grandmother and grandfather in the country a lawbreaker almost every time they leave the house for any length of time.

Yet, the Constitution gives no authority for the federal government to regulate drugs of any kind. There is zero authority for Congress to even consider this subject.

Let's tell them to repeal that foolishness.

Congress has zero authority to regulate that stuff, yet they get the grandparents hassled.

Well--this grandparent will have to have another carry on--just for pills--LOL! (If you don't want to take a lot of medicines, don't have a heart attack.)

Is it true that in some towns there are still laws on the books that if you enter the city limits in a "horseless carriage" someone has to walk ahead of you waving a red light, warning people of your impending approach?

How does this guy get from the undoubtedly silly airport law to being a "lawbreaker almost every time they leave the house for any length of time"?

Writing this kind of infantile hyperbole doesn't help the case of the author

So let me get this straight: It's now a Federal no-no to keep your medicine (when you fly) in those weekly/daily pill holders or the like? Who came up with this bird brained regulation??

This law exists and is abused, by police, fairly often. There is absolutely no need for such a law.

Correct. It is also against some state laws.

Agree on the insanity upon us with regards to this and other "laws". As to the commercial airline industry they can dry up and go broke for all I care. I refuse to lay out my life and be subjected to the degrading bullsh*t those TSA wannabes dish out by shaking down my personal effects and running backgrounds on me just so I can go from point A to point B.

A goobermint that is willing to blow a commercial plane out of the sky with an air to air missle from a F-16, yet drags their feet on allowing pilots to defend their cockpit with a handgun ,.......IS NOT CONCERNED WITH MY SECURITY !

Stay Safe !

Well, there is the commerce clause, even though this is a specious and totally inappropriate use of it.

That's the quote from the post. I don't read any airline in there. Just what are you talking about?

There is such a law. I know because I saw recently where someone was charged with having their medication (Xanax)out of the original conainer.

The reason it stuck in my mind is I know a really nice, extremely law abiding (pretty too)little girl who carries Xanax in a 35mm film container because She is a little ashamed that She has to take it occasionally for anxiety. This girl would never knowingly break any law, including speeding. I know because I was riding with her one day and she kept right within the 55 limit the whole way.

With the abundant information provided, it's obvious to tell this happened at JFK, involving a senior citizen simply carrying her blood pressure medicine.
There is no link to the actual story, which is how I know it wasn't a 26 year old woman caught in an airport with narcotics (even without the properly labeled container present, it's evident the pills could have only been prescribed to her) stuffed in balloons or condoms she swallowed or shoved up her rear.

How could you possibly need more info (like names, places and facts) about how the author establishes the premise for his article?

The connection to the airport is the pill container was found during a search at an airport.
This would be like an no knock search by the homeland securty forces, there finding an expired pain pill your dentist gave you. Against federal law.
You could be kept in jail until the threat to our security was gone. Relax.

It's not an airport law. It applies to everyone, everywhere -- it was just applied at the airport.

His point is that one violates the law by simply distributing your prescription drugs from their original bottles into one of those "7-day" pillboxes and taking it out of your house (transporting them).

I don't believe the framers of the constitution gave authority to regulate laser pistols either.. but one day those will be regulated too. They probably didn't think you could put a nuke in a backpack either.. of course I don't think you want people running around with those legally either. Open your eyes to a little moderation libertian friend before you fall over the abyss of insanity.

My wife is a transplant recipient. She takes a handful of prescription medicines twice a day. Uses two very large seven-compartment daily pill containers to "load up" and organize a week's worth of her daily dosages at a time. Always carries them with her on trips.

This is so foolish, it's unbelievable, but yet all-too-believable.

Not only that, but wouldn't you expect a reference to the U.S. Code in question, or at minimum a snippet of language from the law itself?
