Fairfax County Attorney Robert Horan announcing charges against Mohammed and Malvo in Fairfax County! Will ask Juvenile Court to transfer jurisdiction so Malvo can be tried as an adult (i.e. death penalty)
Says there is NO bickering going on between prosecutors in MD, VA, and US. Says is it the DUTY of each prosecutor to bring charges for murders in their jurisdictions.
Horan is a Rat but a tough prosecutor.

Would they be tried at all by the Feds?
That may not be a good thing. I defer to attorneys out there but it seems like there could be double jeopardy problems for state actions against them with that, depending on what charges were brought and what the outcome was.
If they were convicted on Federal homicide charges (and it may be the only Federal jurisdiction would be for extortion with a firearm or for terrorism - the FBI and NOAA employees were off duty and not on federal property) and there was an unsatisfactory outcome, e.g. acquittal or less than the death penalty, I don't know that they could be tried again in the states for whatever homicides were involved in the Federal charges.
OTOH each state where a homicide was committed should have a crack at them, irrespective of the outcomes in the other states. Because, after all, they were different homicides in different jurisdictions. An acquittal in one state shouldn't hold up their being tried in another.
Disclaimer: As often happens, I don't really know what I'm talking about. But that's my understanding of it.
I hope so too. At least in Virginia Malvo can be threatened with the death penalty, which he can't be in Maryland. His plea-bargained testimony might be needed to make the case against Muhammed.
But I don't think a Virginia plea bargain would be binding on Louisiana or Alabama or any other state where they killed people. That could get interesting!
