Remember when Bush chastised Gore during the debates about following the rules when Gore kept interrupting-- how some people feel that rules are meant to be followed? We can use a little of that kind of talk again from the Bully Pulpit.

No, anyone can resign, its the replacement attempt that is illegal.

The keyword we need to use is that Torricelli 'FORFEITED'. He didn't die, he isn't incapacitated, he hasn't yet been convicted of a crime that would prevent him from running. He 'FORFEITED'.

Like in Florida, the battle of PR and terminology is going to be important.

Or he will mysteriously die from a previously undiagnosed heart problem - just in time for an appointment to be made and the incumbant's name to be placed on the ballot (as per earlier post reference).

We're back to court decisions?

They HAVE to want a court fight for PR. Otherwise, Torch would have resigned and let the appointee be on the ballot. Napolitano made it sound like an appointee would be on the ballot without question.

They are losing nationally, and thus dividing and inflaming are their best options left. Fire up the base, force the GOP into a mudfight, and hopefully disgust the middle/swing voters and reducing their turnout.

It will backfire on them, though. This is energizing folks nationwide. No one wants another 9/11, and no one wants this charade of politics to continue. Even sheeple know when they are not being led to green pastures.

I might add that give that the Dems have already filed papers today in the court, it was clear someone was writing this little petition up BEFORE Torch said he decided to quit, and probably before the idea even popped into his brain late last night. Curious.

You have asked for an analysis of New Jersey ballot statutes and regulations regarding a possible vacancy in connection with the upcoming election in New Jersey. New Jersey law explicitly provides that when a vacancy occurs among primary nominees, the state committee of a political party committee may select a replacement candidate. N.J. Stat. § 19:13-20. However, this ballot replacement is only allowed when the vacancy occurs more than 51 days prior to the election. Id. Inside of this 51 day statutory window, a replacement candidate can not be put on the ballot. The only exception ever recognized by a New Jersey court was in the case of the death of a nominee. Petition of Koegh-Dwyer, 106 N.J. Super. 567, 256 A.2d 314 (1969), affirmed 54 N.J. 523, 257 A.2d 697. It is worth noting that the time limit was raised from 34 days to 51 days in 1985. Legislative history from the original statute states that time limit was included "to afford election official sufficient time in which to attend mechanics of preparing for general election." Kilmurray v. Gilfert, 10 N.J. 435, 91 A.2d 865 (1952).

If the above is cited correctly, they are toast. The key is him not resigning.
