Planned Parenthood Seeks Special Treatment by State Attorney General
ISSUE:
The California Medical Board has asked California Attorney General William Lockyer to render an opinion on Planned Parenthood's duty to report sexual abuse of minors, the issue being client privacy. Pediatricians are required to report sexual abuse of minors and Planned Parenthood should be no exception. An outpouring of calls, letters, and faxes are needed to Bill Lockyer rejecting the notion that Planned Parenthood should be given a waiver on reporting crime.
BACKGROUND:
When an adult impregnates a minor girl, he commits statutory rape, a punishable crime. A study by Michael Males of UCI shows that statutory rape is the most common cause of unwed teenage pregnancy. In recent months, an expose by Life Dynamics Inc. of Denton, Texas revealed that numerous Planned Parenthood clinics avoided reporting such sexual abuse of minor girls.
A patient/doctor confidentiality relationship should not impede reporting a crime. The issue here is protection versus privacy of minors, and protection must prevail lest minors continue to be abused, exploited and molested. To invoke an adult patient/doctor confidentiality between an abortionist or counselor and a sexually abused minor is to open the door to sexual predators of children.
In essence, the Attorney General will be rendering an opinion on whether the failure to report sexual abuse of a minor is a right to privacy or an obstruction of justice.
TAKE ACTION!
Attorney General Bill Lockyer needs to hear from you now. Call, fax and write telling him you expect children to be protected from predators regardless of what medical services they are receiving and that Planned Parenthood is no exception. Carbon copy your faxes and letters to Senator Dick Ackerman; both Lockyer and Ackerman are running for the Attorney General office in the November election.

Planned Parenthood is a recognized 501c organization. That means that it accepts donations and operates as a non-profit organization. Depending upon how they are defined by the Secretary of State's office, the organization must comply with all state and federal codes related to medical clinics.
Since medical procedures are conducted in the medical clinics, any judgement by the California Medical Board other than enforcement of minor reporting laws would undermine the legal authority and legitimacy of the California State Medical Board.
Frankly, I am surprised that Planned Parenthood would actually assert the ability to ignore mandatory reporting requirements under California state code.
In reviewing the pertinent codes, which can be accessed by freepers at http://leginfo.ca.gov, you can review the mandatory reporting laws currently in existance. Here are pertinent portions of the law:
11165.7. (a) As used in this article, "mandated reporter" is defined as any of the following: (21) A physician, surgeon, psychiatrist, psychologist, dentist, resident, intern, podiatrist, chiropractor, licensed nurse, dental hygienist, optometrist, marriage, family and child counselor, clinical social worker, or any other person who is currently licensed under Division 2 (commencing with Section 500) of the Business and Professions Code.
(22) Any emergency medical technician I or II, paramedic, or other person certified pursuant to Division 2.5 (commencing with Section 1797) of the Health and Safety Code.
(b) Volunteers of public or private organizations whose duties require direct contact and supervision of children are encouraged to obtain training in the identification and reporting of child abuse.
(e) The absence of training shall not excuse a mandated reporter from the duties imposed by this article.
Unless these abortions and examinations at Planned Parenthood facilities are being conducted by unlicensed medical personnel, the individuals conducting such medical procedures MUST by law report the abuse. Failure to report the abuse is unlawful.
And that, my friends, is why the California AG needs to get some back bone and start holding Planned Parenthood accountable for failure to follow laws that every small physician must follow. Please post the exact legal arguments being made by Planned Parenthood in this matter. I would like to review their argument.

The Abortion Industry Wants an Exemption from Reporting Sexual Abuse of Minors
After a July 30 meeting of the Los Angeles Board of Supervisors, where information was presented regarding the failure of abortion providers to report instances of statutory rape, Supervisor Michael Antonovich wrote to the Medical Board of California to inform and inquire about this issue.
In the Medical Board's September 5 response to the Supervisor's letter, the Board expressed this view:
"This scenario presents an interesting legal question: A physician's failure to make a report pursuant to the Child Abuse and Neglect Reporting Act vs. their responsibility to honor the patient's right to confidentiality. Before the Medical Board decides the best course of action in this situation we want to be certain there are no conflicts in the law that create a legal minefield as it relates to physician reporting responsibilities in these instances. Therefore, I will forward this issue to the Office of the Attorney General, Health Quality Enforcement Section for their review and opinion. As soon as I receive an answer I will let you know what course of action the Medical Board will take."
ACTION: The Medical Board apparently believes it will receive an opinion from the Attorney General's office within a couple of weeks, so action should be taken immediately to do the following:

Tell him that you expect abortion providers to report child sexual abuse. These crimes must not be covered up with abortions and a return to the same abusive environment.
