Seems to me that if the judgement hadn't been overturned, then every museum in the country would have had to fork over its human remains to anyone who could claim even a remote ancestry.

That's already happening. Buhl Woman, who looked like (from quick observation) Kennewick Man was reburied by the Indians immediately after it was discovered.
