Anne Arundel County's prosecutor will ask a grand jury next week to decide whether an FBI agent who mistakenly shot and wounded a Pasadena man in March should be indicted in the case.
Instead of determining himself whether the shooting was justified, State's Attorney Frank R. Weathersbee will begin presenting the case to a grand jury Tuesday, authorities confirmed yesterday.

In my opinion, if you refuse to testify in a trial against yourself, you're guilty, or at least have something to hide.
It doesn't suprise me that he still has a job, the LEO elite look after their own. This POS (Braga) will walk, mark my words.
This should be an interesting charade.
Five FBI agents in South Florida, two of them the top FBI agents in West Palm Beach and Ft. Pierce, FL. are being investigated by the FBI Office of Professional Responsibilty in Washington D.C. for allegedly lying to protect the top FBI agent in Annapolis (Anne Arundel County) Dave Midura and one of his assistants, Marina Murphy concerning a sham FBI investigation done by Midura and Murphy (two very corrupt FBI agents).
Midura is believed to be the boss of the FBI agent that did the shooting.

It was not mistake; the F.B.I. agent intended to kill the young man.
And that 'apearance' would be that of a whitewash. Every incident of this sort has consequences - unintended and otherwise.
Mr. Schultz had no "screwdriver," nor was a "known perp" with "many priors."
The F.B.I. agent who shot Mr. Schultz, should be in jail; he is an idiot.
Oh, the F.B.I. agent was once upon a time a U.S. Marine Corps officer; but he is still an idiot; and perhaps he was an idiot even then.
Braga screwed up, and the penalty is punishment, not "return to service."
Example: If Schultz had turned out to be the son of Braga's sister, living in Milwaukee, WI, and she called Braga to tell him that a Wisconsin-based F.B.I. agent had just shot her boy, Braga's nephew ... you can bet that F.B.I. Agent Braga, with this matter being a tragedy for HIS family, would be howling and a hootin'. If it mattered to him.
The guy's a jerk; a screwup.
There are many alternatives to how the scene could have been conducted by L.E., but they chose to force a showdown.
No mistake; they meant to tip an incident if they could.

LOL, there was never any question on weather he would walk or not. LEOs are NEVER and I mean NEVER held responsible.
The LA cop responsible for the Rampart corruption scandel - murder, torture, frameing people, etc. - the "kingpin" in that scandel got 1 year in prison.
Accidently shooting an innocent man in the face will only get him a paid vacation and a promotion.
In this case, legal experts say, the grand jury proceedings offer prosecutors a way to shift responsibility for a possible indictment of a law enforcement officer while showing that they take the shooting seriously.
FBI agent Christopher Braga screwed up big time when he shot a totally innocent young man point blank in the face. Then The FBI screwed up by returning Braga back into service.
"It can be also used to satisfy the public that a certain problem has not been ignored," said Abraham A. Dash, who teaches legal ethics at the University of Maryland School of Law. "I can't say for sure, but it has that kind of appearance."
Appearance??? Up goes the "window dressing".
Weathersbee, who is up for re-election this year, can also avoid criticism if charges are not filed.
"For political reasons, prosecutors sometimes take the case before a grand jury looking for a stamp of approval from the community," said Byron L. Warnken, a professor at the University of Baltimore School of Law. "Particularly when there's controversy involved, the prosecutor can then say, 'Hey we didn't make the decision. We took it before 23 citizens, and they decided.'"
Well now, isn't that special. Justice be damned! Weatherbee is up for re-election, let politics rule the day.
Asked if politics played a role in the decision to bring the shooting before a grand jury, Riggin said, "That is absurd."
No doubt when politics play a role in criminal matters it is absurd. Notice that Riggin didn't say one way or the other. He merely made the obvious statement that it is absurd. Well, shooting a totally innocent person point blank in the face is even more absurd, and way beyond absurd when it's an FBI agent doing the shooting.
For that matter, any of us could get shot in the face tomorrow. Does it really matter after we are shot in the face, if the guy who shot us had a badge or not? Does your face hurt more or less if he had a badge?
