School Policies Promote Homosexuality, Legal Group Charges

CNSNews.com) - California parents are protesting school policies which they say allow teachers and school staff to talk about homosexuality with children and openly discuss their own homosexual lifestyles with students during classroom instructional time.

The California Student Safety and Violence Prevention Act of 2000 (AB 537) does not obligate schools to tell parents about classroom instruction that might conflict with their religious or moral beliefs and does not give parents the opportunity to take their children out of the instruction, legal analysts said.

The law met one of its first legal challenges when parents of students at Hayward Unified School District (HUSD) in Hayward, a suburb of San Francisco, said recent policies enacted by the school board under AB 537 are in direct conflict with parental authorization required by the state's Education Code.

At issue is an April 10 resolution by the school board directing the adoption of a "safe school plan" to protect students and staff from harassment or violence.

"The 'Safe Schools For All' training is intended to address the issues of school safety for all students and staff, particularly lesbian, gay, bisexual, transgender, or questioning youth and staff," the resolution said.

Attorney Brad Dacus, president of the Pacific Justice Institute, which is representing parents opposed to the law, said the HUSD resolution unilaterally overrides parental rights guaranteed by the California Education Code and federal law.

"The school board mistakenly believes that allowing teachers to flaunt homosexuality to students is required, and they are wrong. In fact, the district is exposing itself to potential costly litigation," he said.

Supporters say AB 537, which was signed by Gov. Gray Davis (D), prevents violence in public schools by adding actual or perceived sexual orientation and gender identity to the nondiscrimination policy in the state's Education Code.

Kimberly Hammond, the HUSD chief administration officer, said the intent of the resolution is not to "teach about homosexuality."

"The curriculum and the training for the staff is intended to help them address issues of school safety," she said. "So there is not per se a curriculum for teaching about gays and lesbians."

Under the law, school district employees, "like those of all public entities, are prohibited from discriminating against individuals on the basis of race, gender, ethnicity, age, religious creed, sexual preference and/or orientation, marital status, physical or mental disability, ancestry or national origin.

"HUSD has an obligation to provide proper training to comply with applicable laws and board policies to support safe environments for students and staff that are free from discrimination, violence or abuse," the resolution said.

Nancy Moore, a Hayward parent with two children in local schools, said the interpretation of the school resolution conflicted with the values she teaches her children.

"As a parent, I want academics taught to my child," Moore said. "If they want to socialize the kids as far as family issues or sex education issues are concerned, put it in sex education curriculum, send a note home to the parents letting them know they're going to have a speaker to discuss this. Let me know what's going on."

Instead, the attitude of school district officials was that they were going to integrate homosexuality into the normal curriculum, that they were under no obligation to inform her, and if she protested, it was because she was prejudiced, Moore said.

"And that's not the truth. What I'm asking is for Hayward Unified School District to stick to the Education Code. I'm asking for every student and every teacher to be respected. I'm asking for the law to prosecute individuals who harass or commit violence against another individual," Moore said. "But don't force something down my throat."

After being contacted by Hayward parents, Dacus sent a letter to the Hayward school board saying the resolution lacked legal justification and demanded that the policy be rescinded.

However, Dacus said he anticipates more and more California school districts to adopt similar policies. He rejected the contention that such policies are needed to protect students and teachers from being harassed.

"The fact is, the safety umbrella is what is being used to justify all of these aggressive campaigns that do nothing less than openly promote homosexuality to students who are working through very sensitive gender identity issues in their early adolescence," Dacus said.

All gays aren't pedophiles. And just because some of them are, doesn't mean that beating others of them to death or within an inch of their lives, or psychologically torturing them until they commit suicide, is any more acceptable.

Yeah right! The National Education Association has taken up the pro-homosexual agenda by encouraging schools to introduce pro-homosexual material to students. This is a subtle plot to recruit young children to the homosexual life style.

Sometimes I think that the educational establishment is rather fixated on delving into these periferal topics to education because they find it entertaining, and "easy."

I wish that were the reason. But it isn't.

Schools are obligated to tell parents about classroom instruction if parents will take the time to file a copy of the "Hatch Amendment letter" with the school.

Amen, bro. It's incredible how effective the "safety" argument is. Because actual violence against students perceived to be homosexual isn't nearly as prevalent as they want you to believe it is, parents who are informed of the few-and-far-between horror stories panic and say, "Something's gotta be done." They don't know that for parents who want to teach their children their own values, the "cure" is worse than the disease.

Here's some interesting information from the The Education Intelligence Agency (EIA) COMMUNIQUÉ (On the Web at http://www.eiaonline.com) -- May 13, 2002 issue:

"1) Are the Fat Years Over for NEA and AFT?

It used to be relatively easy for EIA to obtain accurate, up-to-date membership numbers for NEA and its state affiliates, but recently it has become a lot more difficult. Perhaps it is coincidental that the numbers are becoming harder and harder to find just as the news becomes less and less cheerful.

The tremors are small: lots of talk about needing inroads with Generation X teachers... financial problems here... possible layoffs there. In the past, membership problems were localized in the chronic, hard-to-organize states that had competing organizations. Today, the sounds are more widespread. NEA has grown every year since the mid-1980s, but for the first time the end of the boom may be in sight. The union experienced an increase of some 37,000 members this year -- about half of what it achieved in 2000-2001. More alarming if you're an NEA official is the fact that 20 state affiliates had a decrease in membership last year -- even as the number of potential members nationwide continues to grow at a fairly steady 2 percent annual clip.

EIA cannot yet identify which state affiliates are growing and which are not, though it seems safe to assume that the large states -- California, New Jersey, Michigan, Illinois, et al. -- continue to enjoy solid growth, while perennial weak sisters are now having serious problems. Activities to reverse the trend are already underway. The NEA Board of Directors granted $175,000 to the Mississippi Association of Educators for additional organizing. The North Carolina Association of Educators is laying the groundwork for an effort in support of collective bargaining in the state. North Carolina law currently bans collective bargaining by teachers.

Accurate AFT numbers are even harder to amass, because more of its members are not K-12 teachers. Nevertheless, the same tremors are coming from AFT. The AFT Executive Council's organizing committee met to discuss ways to get younger members more involved and active in the union. EIA estimates that about 70 percent of teachers are NEA and/or AFT members. Public school teaching may be the most highly unionized sector of the American workforce (the private sector is only 9 percent unionized). Is something about to give?"

Please note that the AAE is not a union. It is a professional association. Annual dues are $125 per year for teachers (includes $2 Million liability insurance - one of the reasons teachers join the NEA or AFT is for liability insurance). Student, retired educator, and associate/support memberships are $25 per year.

Call the AAE and ask them to send you some of their brochures. Stuff them with Teacher317's "UNION DUES REFUND NOTICE" and hand them out to teachers and education majors. Take them to PTA/PTO meetings. Leave copies at school supply stores.

You mean to say that all these years I've just had a "preference" for females? Sounds a bit weak for what goes on when I see Heather Kozar on the Price is Right.

Thank you for the Hatch Amendment Letter. It occurred to me that the topics listed in the letter belong in a sociology class at university level. The fact that we pay taxes for the agenda being promoted, is stating that we, the people, promote homosexuality.

I hope everyone will take the time to notify their school officials that this will not be tolerated. It might not be a bad idea to also notify one's reps.

Unfortunately I don't have time to respond to every homosexual-specific article posted on FR but I try to read most of them.

Clearly the homosexual activists are gaining ground rapidly, especially in the public schools. Parent awareness is the best weapon we have to thwart this encroachment on the rights of parents to install clear moral values and prevent the mental abuse of our vulnerable children, captive to homosexual propaganda delivered by authority figures absent parental notification or any parental involvement at all in most cases.

Unfortunately, years of homosexual activist brainwashing of parents (via the media) and the demise of the close, involved, two-parent family has made more children easier to confuse and indoctrinate with pro-homosexual material.

Truth is the only real weapon we have to fight with but we must brandish it freely and not be intimidated by the usual homosexual deflection methods of name-calling ('homophobic', 'bigoted', 'judgemental' and the rest that we're all too familiar with). They're after our children. It's not debatable anymore and as Bob Knight said, if parents knew what was happening in school 'sex ed' classes, you couldn't contain the outrage. Let's hope so.

Contrary to popular belief, Matthew Shepard wasn't beaten to death just because he was gay. He was beaten to death by two thugs who were already on a strongarm robbery crime wave (Shepard was their second victims of the night).

The more you learn about the Matthew Shepard killing, the less it looks like a hate crime. All the evidence points to the truth being that Shepard was chosen because to rob because he could be relied upon to jump in the truck that Aaron McKinney and Russell Henderson were riding in.

Important to consider is that McKinney and Henderson got into a fight with a some Hispanic teens later that evening, and it was McKinney's pistol-whipping of one of them that led police investigating that assault to the pistol-whipping murder of Shepard. McKinney was not charged with a hate crime in that incident, if he was charged at all.

The idea that the killing of Shepard was some sort of 'threatening message to the community' -- which used to be the narrow criteria separating "hate crime" from run-of-the-mill "crime" -- falls apart when you examine the case. Henderson -- who confessed and implicated McKinney as the one who initiated the attack that killed Shepard -- said that McKinney whacked Shepard in the skull with his gun after Shepard was still able to read the license plate number of the truck -- as he was ordered to do by McKinney. No anti-gay slurs were reported during the attack, according to all witness accounts that I have read. The "hate crime" charge hangs on the slim thread of the killers' use of anti-gay slurs when recounting the [beating that led to the] murder to their girlfriends (both [girlfriends] were charged with being accessories after the fact and pleaded guilty to reduced charges).

The so-called "gay panic" defense that McKinney and his counsel came up with was blocked by the judge. In Wyoming, there are restrictions on diminished capacity defenses. Still, chances are the strategy probably would not have survived serious examination, considering that we now know that McKinney's insistence that Shepard had groped him was contradicted by his videotaped confession to the beating death.

It is not impossible that Shepard's killing was out of "hate," but we will never really know. That's because part of the bargain that saved Aaron McKinney from execution in that case was his agreement not to discuss the case -- a "self-imposed" gag order at the insistence of Shepard's parents and at the threat of life on Wyoming's death row. This was not just a prevention of Henderson potentially profiting from his crime, a la Mumia Abu-Jamal and John Wayne Gacy -- he can't even talk about the murder to a reporter for free.

That post-trial, post-sentencing gag order is surely a First Amendment violation, but it likely will never make it to the SCOTUS...or the front page of the NY Times, either.

I expect schools to teach students that any sort of violent behavior is wrong and unacceptable (including against anyone perceived to be homosexual). That is FAR, FAR different from promoting homosexuality (a dangerous and filthy disordered inclination) to my kids.
