WHEN THE JUDGE GAGS A KEY WITNESS FOR TRUMP’S DEFENSE. The false bookkeeping trial of former President Donald Trump is now in its fourth week. This newsletter has pointed out lots of times, most recently last Friday, that while we know that Manhattan District Attorney Alvin Bragg has charged Trump with falsifying bookkeeping records of a nondisclosure payment in order to commit or conceal another crime, Bragg still hasn’t revealed what that other crime is. It’s really the key to the whole case. Without the other crime, there would be no charges against Trump in this matter. The fact that we — and that includes the defendant — still don’t know what the other crime is is one of the great injustices of a felony prosecution that never should have happened.
But now we’re getting an idea of where prosecutors are going. Perhaps the leading theory — they’re all just theories — of the other crime is that in addition to violating New York’s misdemeanor law against falsifying bookkeeping records, Trump also violated another New York misdemeanor law, 17-152, which prohibits conspiring “to promote or prevent the election of any person to a public office by unlawful means.” Put those two misdemeanors together, and bingo! Trump stands accused of 34 felony counts, which could put him in prison for a maximum of 136 years.

Falsifying a record suggests you think you’re knowingly being nefarious about calling a legal expense a legal expense.

This is a State of New York court, trying Trump on violating State of New York accounting laws.
I would think he could say what ever he wanted to say outside the state lines of New York.

The judge donated to Biden in 2020. He also donated to a “Stop Republicans” organization that year. He is a crook.
I’ve heard and reposted this before here, but I believe judges enjoy broad immunity from civil lawsuits thus cannot be sued for any reason ever. Their decisions can be overturned upon appeal much later but none of that seems to occur in a timely manner. And. And. Trump would have to go through layers of NY Appellate courts in his appeal process first, courts that have been previously hostile to him before and thus show no reason for hope they would not again be hostile. He might have to go through being denied appeal relief several times? before it could progress to the Supremes. None of the NY Appellate courts have any reason for us to expect a fast appeal decision; they would all likely drag it out to keep that/those felony convictions standing well past the election. Infuriating, yes. Perhaps someone here more knowledgeable knows how many layers of NY State appeals courts there ARE to be gone through before his appeals reach the USSC? One or many? I think a party might be able to attempt to leapfrog over other lower courts on an emergency basis but the courts historically don’t like that, aren’t required in any case, to actually hear the appeal, and might deny it out of irritation that due process was not followed. I think Jack Smith tried this in Florida?

Jurors usually like the judge, and the judge decides what they see and hear.
Jurors don’t usually blame the judge for the fact they aren’t allowed to hear everything.
Especially in NYC, these Jurors undoubtedly love the judge.

What really sucks is that no matter what they do. No matter what rules or norms they break no one on the left will ever think they went too far. That’s just not something we will see. They can hang him in a public square, rape his wife or shoot his child in the head and the new stations will explain why what was done was within the parameters of law.
