Arizona rancher George Alan Kelly will not be retried after deadlocked jury, prosecutors announce

George Alan Kelly, the Arizona rancher charged with murder in the shooting of a Mexican national on his border property, will not be retried, prosecutors with the Santa Cruz County Attorney's office said.

The state charged Kelly with second degree murder after he allegedly shot and killed a migrant, Gabriel Cuen-Buitimea, on his land in January 2023.

The decision not to retry Kelly comes a week after a mistrial was declared following a deadlocked jury.

Kelly’s defense confirmed to Fox News Digital that there was "one, lone holdout" juror who wanted to convict, while the remaining jurors sought an acquittal.

Only one jurer would not vote to quit. The case was super weak would never go to trial in a sane world.

Good. Now I hope there isn’t some nonsense civil lawsuit aimed at bankrupting the man.

They did talk to the jury which was 5-1 for acquittal.

It was reported as 8-1 for acquittal.

8-1 was reported.

9 is a very strange number for a jury.

Amazing. My new neighbor, a nice woman from the Rio Grande Valley in far south Texas, had a border patrol agent knock on her door to tell her that a dead illegal found on her property. Told her it was a good thing he died before he could attack her.

“Move as far north as you can as soon as possible.”

That’s the right kind of border agent. All others can go suck rocks

More than likely it wasn’t George. Hitting a target at 100 yards with the average AK takes a bit of luck. Maybe Ol’ George is quite the marksman, maybe not.

” The case was super weak would never go to trial in a sane world.”
Neither would the case against Officer Derek Chauvin, in a sane world.

Arizona law requires 8 person juries for crimes punishable with less than a 30 year sentence.

I was once on an 8-member jury, but that was for a civil matter, not a criminal court, and it wasn’t in Arizona.

“I suspect that the prosecution was able to talk to the jury and found that the majority would have found him not guilty.”

Jury informed Judge that they coul not reach a unanimous decision. Judge declared a mistrial.

Not a majority decision. One holdout either way deadlocks the jury.

Looking at the overhead view of his place, it seems unlikely he could see the place where the body was found from his porch. There are a lot of mesquite trees. Pretty thick, in fact.

It was not an ethnic decision; this Arizona county is 83 percent Hispanic and they didn’t buy the BS from the prosecutor.

Ethnicity/nationality have nothing to do with it. Most Hispanics who made it here legally and became citizens like illegals even less than we do!
