Kari Lake asks court to decide damages in Maricopa County official’s defamation case

Kari Lake is asking the court to quickly issue a judgment and to decide how much she will pay Maricopa County Recorder Stephen Richer in the defamation case he brought against her, according to a filing in Maricopa County Superior Court on Tuesday.

Richer sued Lake — who ran for governor in 2022 and is now running for U.S. Senate — for defamation last year, alleging that Lake made defamatory allegations that he had assisted in rigging the gubernatorial election against Lake. They are both Republicans.

Lake’s attorneys do not defend Lake’s claims about Richer in the filing, nor do they challenge any of Richer’s arguments about the facts. Instead, they ask the court for a quick hearing to decide damages.

Throwing liberal media articles at me is not the way to convince anyone.

Notwithstanding, the case was about whether she acted with malice or not, not whether or not she said certain things, which she never denied. And a liberal judge unilaterally decreed she did. Thoughtcrime. And you’re upholding this violation of the First Amendment.

I haven’t seen anything about such a declaration by a judge. Lake wanted the court to declare that she DIDN’T defame Richer, and therefore to throw his case out. The court ruled instead that the question had to be presented to a jury. That jury trial is the procedure that Lake has now short-circuited, by conceding liability.

Read the article linked in post 20. Go to about the middle. Everything is all about the judge’s opinion rather than the law, rather similar to what Engoron unilaterally decided w.r.t. Trump.

I read that article – and I thank Sacajaweau for posting the link. As I read it, the judge didn’t rule that Richer was right. He simply declined Lake’s request to rule that Richer was wrong and that Lake should win without a trial. Under the judge’s decision (upheld on appeal), the issues would be left for a jury.

An article at https://kjzz.org/content/1873242/arizona-supreme-court-wont-dismiss-stephen-richers-defamation-suit-against-kari-lake (apparently from an Arizona radio station) gives this account:

“Maricopa County Superior Court Judge Jay Adelman denied Lake’s request to dismiss the case last year, finding Lake’s attorneys failed to prove Richer brought the suit for an improper purpose. An Arizona Court of Appeals panel declined to consider her appeal of that decision.

“Lake, who is now running for U.S. Senate, appealed the ruling to the Arizona Supreme Court in January.

“The high court issued an order denying the appeal and lifted a stay, which allows the case to proceed to discovery and trial.”

Now, the result of Lake’s filing is that she can’t get discovery about Maricopa County’s election procedures, and she can’t present her evidence on that to the jury. If the court grants the default, as requested by Lake, then the only issue for the jury will be how much money to award Richer as compensation for Lake’s defamation of him.

Hence the rush to damages so she can appeal. It’s a waste of time and money to argue with the bought and paid for judge.

More like, now there is no reason for her to testify in front of a jury as she has admitted liability. Now she removes herself from committing perjury at trial...which she is stupid enough to do. As I’ve stated for forever, she’s a loon.

I don’t have a smoking gun on Votebeat.org, and did not mean to imply any fault for posting their article.

It’s a new name to me too, and because what they were saying struck me as odd, I tried to research the organization and its funding. Everything I found was unsatisfactorily vague — “we’re, uh, independent, and we get money from supporters”. It is related to “Chalkbeat”. Both have a parent organization called the “Civic News Company” based in NYC.

Civic News Company’s site says as an “organization grounded in the values of equality and antiracism, we prioritize coverage of the key systems that shape this country and prioritize serving communities often neglected by traditional media.” This might mean they are trying to fill the gaps in the dying local news industry. But the George Floyd articles, the layering of organizations, etc., gave me the feeling of leftists pretending to be independent. My gut feeling could be wrong.

I appreciate your comments on the Lake case. I need to research it further and try to make sense of the “why” of it.

From what I’ve read, there are at least some questions. For example, Lake pointed to a problem with the way the ballots were printed, as part of her accusation of fraud by Richer. It turns out that he and his office had no role in the printing of the ballots.

I suspect that Lake just shot her mouth off (and defamed Richer) without troubling to identify the real culprit. That would explain why she doesn’t want to try the issue.
