Ah, you’re referring to the Korean ‘Police Action’. The last time Congress declared war was in June, 1942 against Bulgaria, Romania, and Hungary. We haven’t been legally at war since the end of WWII.

One reason why Jane Fonda couldn’t be charged with treason with her photo ops in North Vietnam, is that although Americans were fighting and dying, we weren’t legally (or Constitutionally) ‘at war’.

‘Treason’ is the only crime specifically defined in the Constitution.
