The Hur Report:Joe Biden "willfully retained and disclosed classified materials"

Special Counsel Robert Hur's Final Report

Last Thursday, the Department of Justice released Special Counsel Robert Hur's final report on Joe Biden's classified documents scandal. In the report, Hur concluded that Joe Biden "willfully retained and disclosed classified materials after his vice presidency."

Hur went on to say that he would not criminally prosecute Biden for his handling of that material -- surprising absolutely nobody!

That these documents contained highly classified material about military and foreign policy, and notebooks containing Biden’s entries about national security became irrelevant.

The report includes an executive summary, 17 chapters, a conclusion and three appendices, covering a total of 388 pages.

The meat of Hur's report can be summarized, as follows:

“Our investigation uncovered evidence that President Biden willfully retained and disclosed classified materials after his vice presidency when he was a private citizen. These materials included marked classified documents about military and foreign policy in Afghanistan, and notebooks containing Mr. Biden’s handwritten entries about issues of national security and foreign policy implicating sensitive intelligence sources and methods. FBI agents recovered these materials from the garage, offices, and basement den in Mr. Biden’s Wilmington, Delaware home,”

“He knew he kept classified information in notebooks stored in his house and he knew he was not allowed to do so.”

"Joe Biden even shared some classified information with his ghostwriter for his second memoir, 'Promise Me, Dad,' published in 2017."

“We have also considered that, at trial, Mr. Biden would likely present himself to a jury, as he did during our interview of him, as a sympathetic, well-meaning, elderly man with a poor memory”

“We conclude that no criminal charges are warranted in this matter.”

Biden’s lawyer, Richard Sauber, said in a written statement, said, “We are pleased that this investigation has concluded and that the Special Counsel [Hur] found ‘no criminal charges are warranted in this matter'."

Sauber should be more than pleased. He should be doing cartwheels

The Documents

Joe Biden or his agents stole classified documents -- including TOP SECRET (SCI) documents -- and improperly stored them at the Penn Biden Center, his Delaware home in the garage, his Virginia home, and in his lawyer’s Boston office. He also shared these documents with unauthorized persons, and in the runup to the 2020 election Biden ordered those documents recovered by persons who did not have the proper clearance to handle them.

The Department of Justice, the FBI, other federal agencies, the Democratic Party, the Democratic media, and a gazillion useful idiots, all must now pretend that Joe Biden was not "grossly negligent" and committed no crime in his storage and handling of the stolen classified documents.

Title 18 U.S.C. 1924 makes it a federal crime to knowingly remove classified documents or materials from their designated locations without authorization or retain them in an unauthorized area -- like a garage!

Penalties for violating this statute can include: imprisonment for up to five years in federal prison, fines up to $250,000, or both. The severity of the penalties depends on the level of classification of the information involved, the intended use of the data, and the harm caused by the mishandling. The Hur Report

On January 15, 2023, when this story first broke, I published an essay -- Grossly Negligent+ -- that made the observation that, "Joe Biden's stolen TOP SECRET (SCI) documents were a very big deal." It described the details of classified document storage, access and control.

Joe Biden neglected to comply with every manual and automated process to safeguard America's secrets. It also points out how the mandatory annual inventory of classified documents produced "red flags" every year that identified the document and the person who signed the document out.

For some reason, these "red flags" were ignored. The Hur Report

Biden took many of these documents when he was a senator and a vice president, when he did not have the authority to take them. He took these documents over a period of many years. He knew it was a crime. Why did he take them? Why did he need them? Did he forget that he had all these documents?

OK, we can see the man has now clearly lost his competency, but why did he keep them in old boxes in the garage? These are nation's top secrets. He treated his Corvette better. Joe Biden's memory

“In his interview with our office, Mr. Biden’s memory was worse,” Hur wrote.

"He did not remember when he was vice president, forgetting on the first day of the interview when his term ended":

"If it was 2013, when did I stop being Vice President?"

"And forgetting on the second day of the interview when his term began":

"In 2009, am I still Vice President?"

“He did not remember, even within several years, when his son Beau died,” the special counsel said, “ and his memory appeared hazy when describing the Afghanistan debate that was once so important to him.” The Hur Report

The back door

So, why did Biden’s own DoJ allow the special counsel’s report to include such damning information about Joe Biden's mental decline?

Hur’s descriptions of Biden’s mental state were the DoJ’s only basis for not charging Biden in light of the report’s finding that he had “willfully retained and disclosed classified materials after his vice presidency when he was a private citizen.”

Hur had to explain why they weren’t going to charge Biden for "willfully" committing what could be hundreds of individual, provable crimes.

The report creates the "straw man" that a jury looking at Joe Biden would say, "I don’t know. That guy has no idea what’s going on," so, we don’t have a chance of getting him convicted, and the FBI guidelines say don’t charge somebody if you don’t think there’s a chance of a conviction.

What the report says -- while not saying it -- is Joe Biden is guilty as Hell, the evidence is overwhelming, but we can't indict our boss, the president, so, let's use this straw man to give us a back door out of this dilemma.

That’s the reason they put it in there. It was all coordinated and approved at the highest levels of the DoJ. Deny, distract and distort

What followed the report's release was OUTRAGE! How dare they?

All day Friday and into Saturday, every Democrat that had access to a TV camera or a microphone expressed their outrage that the report questioned Joe Biden's mental acuity.

How dare that “partisan” special counsel launch a "cheap shot, derogatory attacks" against Biden by saying he has a "poor memory."

Joe Biden responded with a defiant, combative statement at a press conference in which he read from notes, caustically dismissed the report's findings that his memory is fading, insulted reporters, and then, in unscripted comments, confused the presidents of Egypt and Mexico.

Multiple Democrats and mainstream media figures strongly disagreed with Special Counsel Robert Hur's report on President Biden and his "poor memory," insisting that the world leader is "on his game."

Prominent journalists, like former CNN reporter John Harwood, insisted that Biden is one of the "sharpest" people they’ve dealt with and is more than capable of handling his job as president.

Democrats, like Rep. Dan Goldman (D-NY), were quick to play fast and loose with the facts of the Hur Report.

On Saturday, the word went out to Biden's allies. They have been instructed to attack Special Counsel Robert Hur on the Sunday news shows today, smearing him as a political hack and Trump guy.

No Democrat addressed the core of Hur's report -- that Joe Biden "willfully retained and disclosed classified materials after his vice presidency when he was a private citizen” -- they were all too busy being outraged.

It's all smoke and mirrors -- deny, distract and distort -- and the media will continue to play along. The "outrage" will become "the narrative" and the hyperventilating will suppress the true and simple facts that are contained in the Hur Report.

In the end, the Democrats have a simple, binary choice.

If Biden’s memory is as fine as his apologists claim, he needs to be charged with his crimes of willfully retaining and disclosing classified materials. If he isn't going to be charged for those crimes because he's "a sympathetic, well-meaning, elderly man with a poor memory,” he needs to resign or be removed.

Joe Biden -- and the Democrats -- can’t have it both ways. The bottom line

Stephen Miller, who was a senior advisor for policy and White House director of speech-writing during the Trump administration, sums it up nicely.

America is in trouble. We are headed toward a general-election showdown and the Democratic incumbent's condition is growing worse. Americans aren't the only ones who will read Hur's report or watch Biden's televised meltdown. America's enemies will also.

The world was a dangerous place before Thursday. It has grown more dangerous since.

This puts Graland in a very difficult position. The recommendation from the special counsel’s office is not binding on DOJ. They’re required to make their own determination and then state that for the record. When Loretta Lynch told the press that the AG would accept the FBI’s recommendation on prosecuting Hillary Clinton for her email cluster before actually seeing the report, she set a precedent by allowing DOJ to pretend it doesn’t have a brain. Notice how all of these trends float between “someone” and “DOJ” at large being noted as the authority of record. Biden’s level of age and awareness doesn’t matter. The facts are clearly there. He’s not covered by the Presidential Records Act. Garland will likely just sit on this for a while to run out the clock.

Balderdash! Biden is an angry, vindictive, irrational fool. The fact that he 'presented himself' to Her as well-meaning' means that he was drugged into a near stupor. I'm surprised that no one else is considering this.

This otherwise sound article made one basic error.

It implied that adversaries were now more dangerous with this new information about Biden’s mental condition.

Any country’s intelligence agencies that were not previously fully aware that Biden was a cuckoo-bird were themselves grossly negligent—and probably too incompetent to be tried for treason.

Those he shouldnt have had or others were found in 2017...

During both years he was a senator...
