In 1963 Kennedy nationalized the Alabama NG.
In both cases they furthered civil rights.

In this case Biden might try to nationalize the Texas NG, and find the generals refuse. So far the Guard is standing with the governor.

The Insurrection Act says Biden can use the regular Army to bring this under control.

Texas defeated DoD and the administration over the covid vax for National Guard Troops. Nobody that didn't want to take the vax had to and didn't suffer repercussions for it.

My money is on Texas prevailing if they want to. Just protecting Eagle Pass is insufficient though.
