So, a guy lost his phone and the police searched it for photos and videos? Based on what probable cause?

Even a crappy defense lawyer should be able to get this tossed as an illegal search.

The cops didn't search the phone; the restaurant staff did.

More likely restaurant employees viewed the phone, called the police, who, hopefully, got a search warrant.

You obviously didn’t read the article. It was the employees of the restaurant who searched the phone trying to determine who it belonged to, so they could return it, only to find the incriminating photos instead. At that point they notified authorities. Don’t know what your problem is.

If he forgot his phone on the table and the watress discovered the videos and called the cops it is all admissible.
