Pa. Senate recount update: McCormick seeks hand-count in scores of precincts

It should be all over in about one week, but David McCormick’s U.S. Senate campaign showed signs Tuesday of fighting vigorously to the end for a full and accurate recount of the primary contest between he and self-declared “presumptive nominee” Dr. Mehmet Oz. Recount results are supposed to be made public no later than June 8.

The eventual winner will take on Democratic Party nominee and sitting Lt. Gov. John Fetterman in the general election for the right to succeed U.S. Sen. Pat Toomey, R-Pa., who is not seeking re-election.

By day’s end Tuesday, Oz, the former heart surgeon-turned-daytime television star, was still leading former Wall Street hedge fund leader McCormick by 922 votes in unofficial returns. That lead equalled seven hundredths of a percentage points, with Oz at 31.21 percent, and McCormick at 31.14 percent.

In race developments Tuesday:

McCormick’s campaign filed a new petition with the state Commonwealth Court seeking an order for hand recounts of potentially hundreds of precincts across 12 counties where, campaign officials said, they have questions about discrepancies between the total numbers of primary votes cast and votes counted in the Senate race.

The campaign noted it’s normal to have a small percentage of voters skip over a race.

But in the 12 counties in question — identified in the filing as Allegheny, Bucks, Butler, Centre, Chester, Cumberland, Delaware, Lancaster, Monroe, Schuylkill, Westmoreland and York — they are concerned about under-voters that fall outside the norm, and it raises the fears that the discrepancies were the result of “fraud or error.”

No specific allegations of fraud were alleged in the filing, which otherwise raised the possibility of human or mechanical error.

“I wish that we had a clean vote on Election Night and it was all over with. But unfortunately we don’t have that,” a McCormick campaign aide told reporters. “We want the Republican primary voters to know that they have a winner - whether it’s by one vote or a thousand votes - so we can all get behind the nominee and beat Fetterman in the fall.”

The filing asks for the hand recount in at least 150 precincts, but an exhibit submitted with the filing identifies potentially many more.

The McCormick campaign official said he hopes to see the hand recounts completed within the next week, so those results can be made a part of the broader statewide recount that was triggered by the closeness of the margin in the race. Election officials are not required to do a ballot-by-ballot review in the automatic recount.

The two campaigns made arguments on a separate McCormick bid to allow the counting of approximately 860 Republican primary mail-in ballots that were returned on time and signed, but not dated.

The McCormick campaign is eager to see these ballots counted because McCormick has been beating Oz in the mail-in count.

The door was opened to counting these ballots on May 20, when the U.S. 3rd Circuit Court of Appeals, ruling in an unrelated elections case out of Lehigh County, held that Pennsylvania’s date requirement - if all other aspects of a ballot are valid - is “immaterial” and should not be used to disqualify a vote from counting.

Commonwealth Court President Judge Renee Cohn Jubelirer said she intends to rule quickly on the case.

Meanwhile, U.S. Supreme Court Justice Samuel Alito paused the application of the 3rd Circuit order in the Lehigh County case Tuesday, as it is freshly appealed.

PennLive asked the Pennsylvania Department of State Tuesday for an updated tally of how many votes it believes remain uncounted in the GOP primary as it moves toward a complete initial count of results, but State officials had not responded as of press time for this report.

I would say PA needs to clean up their act and implement voting reform, but broken elections is a feature now.

I would be ecstatic if it ended up in an exact tie. More chaos! Hopefully, it would go to the legislature to pick a true conservative candidate who is an actual Pennsylvanian.

For me and my family, we will NEVER vote for carpetbagger Oz. I would prefer the communist Fetterman to win in November, and then hope he croaks in office so the Republican governor can appoint the new senator. The stinking Sean Hannity puppet Oz will never get our vote.

I can understand why there would be undervotes. I was prepared to vote for Governor, Senator and my Congressman. But there were four other votes that I had to make a best guess based on name and location. A lot of people could have left these blank

Unlikely at this point McCormick will find enough votes to overtake Oz. The two candidate vote totals are so close they’d probably need at least 25,000 votes reviewed (of a batch favorable to McCormick) to reverse Oz’s current lead.

This means Oz picked up 20 votes from the reported 902.

I shouldn’t repeat that joke I heard from the writer Harlan Ellison in the 1980s.

The Polish and other regions have produced supermodels and are not the 1950s ones pictured as being able to take over a plow in the rutabaga field if the horses got exhausted.
