Judge Jackson: No Position Regarding Natural Rights

I am disappointed the affirmative vote by these three Republican Senators provides utility for their re-election, because they voted for a black woman; a vote totally disconnected with her qualifications for the office. Focusing on qualifications would have represented a controversial political position for them; a position actively disputed but more often ignored by many of the most influential in the country. When natural rights no longer trump stare decisis, we are only a single five to four opinion away from entering the road that forfeits our liberties as traditionally delineated.

The delegates to the Constitutional Convention found their motivation for scrutinizing proposals from political theories of the Enlightenment that emphasized individual human liberties synthesized into intangible property as defined most immediately by John Locke, William Blackstone, and James Madison. Any government decided upon would for all time recognize Americans as sovereign individuals finding their identity in exercising pre-existing intangible liberties within bounds of voluntary self-restraint and accompanied by the hazards and uncertainties of personal freedoms.

However, Judge Jackson disagreed with that position as noted in the below article. In her defense many say that natural rights are a religious and not a legal principle.

The links I have listed below refute the ideas that natural rights do not exist and that they are religious in character. The United Nations Universal Declaration of Human Rights says, “the inherent dignity and of the equal and inalienable rights of all members of the human family is the foundation of freedom, justice and peace in the world”. It goes on to list thirty articles and no more than possibly four could be construed to include tangible items. The Soviet Union ensured any taint of religion was removed before the document was adopted in 1948.
