I've given that some thought and can't imagine the prosecutor would want another trial. This one went so badly for them. But I've been shocked and dismayed before.
Whether a new trial is begun depends on the political environment, not the legal sense. The DA and ADA need votes to be reelected, and their base is shaky at best.
In my opinion, it is exactly the opposite. The prosecutor desperately wants a hung jury so he can get another trial.
Remember, this is punishment by process. Another trial punishes Kyle severely, and means the prosecutor gets another swing at the ball.
The purpose is to punish Kyle, not see justice done.
If the purpose was to see justice done, no charges would ever have been made.
The prosecutor would love to see a hung jury. From his perspective, it is a significant win.
