A judge cast doubt on the future of a Republican-backed 2020 election audit in Maricopa County that Democrats are trying to shut down through a legal challenge raising concerns about adherence to state election laws and regulations.
Maricopa County Superior Court Judge Daniel Martin, who was assigned to the case on Monday after the first judge recused himself, said that he has some reservations about the review process but needs to hear more during a hearing set for Wednesday.
“I will share with you all, I am not yet persuaded that there has been a showing that the rights of the voters in Maricopa County are being projected,” Martin said during a lengthy hearing on Tuesday. “And I think we will touch on this tomorrow when we address the policies and procedures and whether or not they can be withheld from public view."
The Arizona Democratic Party and Maricopa County Supervisor Steve Gallardo, the sole Democrat on the board, sued last week to stop the GOP-led Arizona Senate's audit, which is being led by Cyber Ninjas, a Florida-based consulting firm, and will include 2.1 million ballots cast, a forensic audit of the voting machines, and follow-up interviews with voters.
Attorneys for the Senate and Cyber Ninjas, whose CEO, Doug Logan, has been subject to scrutiny over his promotion of voter fraud allegations and "Stop the Steal" posts on social media, argue that state election regulations don't apply to the Legislature and the audit and are asking the court to keep the audit's methods under seal as trade secrets.
But Martin appeared to disagree with the immunity argument.
“The manner in which that audit is being conducted must be balanced against the constitutional rights of the voters in Maricopa County, including the rights to secrecy and confidentiality of information,” he said.

Well of course he does. /s
It’s a county judge and this is a state matter. He can have all the “reservations” he wants, he can’t do a dam# thing to stop it.
here comes the tossing of the audit
yet another maneuver by the left to hold power
The judge needs to be called out and investigated.
I hope Arizona Republicans storm that judge’s office, peacefully, of course, like in Portland.
What authority does the judge have to decide this?
None.
Translation : “We need to protect those who stole the election from Trump”.
The Republicans should have or now need to get serious with a 100-plus attorneys of their own, plus private detectives, to unseat the new judge, to and properly defend and carryout this case.
Time for a visit from the Green Suits
Judges can do whatever they want to, as long as it benefits the Left.
I think this is more about protecting the rights of Democrats to cheat.
If this judge can’t rule on it why are there hearings today?
Perhaps we can have a mere lawyer who happens to be a ‘judge’ review the process of special and general relativity also. After all, it makes absolutely no sense that time and space should be different as a function of gravity, energy, or velocity. And, remember that Einstein was also a Jewwwwwwwwwwwwww.
How does one Judge appointed by a bigtime democrat get to override an entire legislature?
He can rule on anything he wants, it’s whether or not it carries any legal consequence.
Is there no justice any more? Why would anyone fight over the audit of an election...unless they knew the outcome.
Judge Daniel Martin is not apolitical. Remember this next time you vote.
Maybe they offered the judge enough money to start having reservations. Must be finding some things in this audit.
OK but why give the Judge any excuse to object? The audit procedures should be public, just like the election procedures should be public. Why the heck should CyberNinjas use “trade secret” methods to conduct an audit??
Appointed by bull dyke Clintonoid Janet Incompetano.
