There is bright hope for President Trump to be declared the winner as that’s the truth.
KEEP IN MIND: Neither state governors nor courts, including states’ highest
courts, have any authority over how federal elections are conducted in their states.
DATES TO REMEMBER:
Dec. 8th...States Certification of Votes, each state has their deadline.
Dec. 14th..Electors Announce their Votes.
Jan. 6th...Joint Session of Congress reads aloud the votes of the Electors.
If Congress wants to refuse them, the Supreme Court would decide which Elector slate is valid (assuming states sent two slates).
Because the Constitution specifically says legislatures select the slate, and Governors are not involved, the Court would have no choice.
The law is clear.
Someone raised the agonizing question......what if the USSC does not want to overturn the election?
The USSC is guided by finite principles ——— who won or who lost is not one of those principles.
In the Bush/Gore decision, the USSC stopped the count......they didnt overturn anything.......they didnt decide who won or who lost.
I am not certain about all of the states, but in Philadelphia they cannot salvage what the elections board and officials did on election night. There is no way to correct it because there is no chain of custody and there was no oversight. I think the same thing is true in Detroit.
No matter what they do to remedy this there will be bitterness. The King Solomon answer is for the legislature to have a special election in those precincts and bring in poll workers from the rest of the state to make the count fast.
It is a hypothetical and many have pointed out (possibly correct) that it might not be constitutional, but I believe the constitution may allow the state legislature to do this. This is the safest punt for the legislature (politicians) and the courts (increasingly politicians).
If Biden thinks he won why not claim a mantle of legitimacy and ask for “run-off” in Philadelphia?
Trump thinks there is fraud so why not ask for a “run-off” in Philadelphia?
Let us see the proof and demand transparency.
The legislature can say we will accept the numbers except for Philadelphia and we will take the new “clean” numbers from Philadelphia and appoint electoral college voters accordingly.
We knocked this around pretty good on a thread last night, but I don’t see any other way that the vote will be trusted and/or the fraud will be verified.
Screw COVID. More people will die in a civil war and this one county is going to tear the fabric of the nation apart and potentially disenfranchise 70 plus million people.
There is a legal path to simply dismiss all of the votes from Philadelphia and in a sane world that would be the most fair option (they elected the election officials). However, this does not fix the problem or give an air of legitimacy to one side or the other who are declared the winner.
Declare a run-off election with court ordered oversight and monitoring and bring in enough people to help them count.
I believe it falls to the PA legislature to appoint electors and accept the results so this would be the safe punt for them.

This would (for most people) remove any doubt in the election results because they will never put Humpty Dumpty together again in Philadelphia. The elections officials effectively committed a fraud.
They will have to expedite any absentee ballots.
