The prosecution is really stretching to find a reason to charge Kyle.
It is impossible to get that sort of trajectory with an empty plastic bag. I have seen other angles, so I do not believe it was a Molotov cocktail. I believe it was a plastic bag with a heavy object in it, to serve as an improvised mace. Notice the front part of the bag is black. Probably a brick or canned goods inside to give it heft.

I have heard others say it was a Molotov cocktail and I thought I saw a flame burst in an early video but it was a bit before the guy go shot.
