The Bill of Rights takes Congressional powers originally defined in the Constitution. ART 1-10 is the operating system the prevents Congressional control to limit or terminate the Sec Admenment as an example.
We have a perfect storm whereby courts are not operating in some places... thus the president can make said declaration of ML for public safety as a self limiting parameter under which Congressional demands would fall not nullify beyond restoration of the State and local law enforcement to step again in their intended role of law enforcement.
Congress would be indignant even if prior consultation was made but the dangerous breakdown in policing by DNC politicians at the state and local (without criticism or Congressional Dems admonitionment to restore order) further the Congress’s legitimate authority as well as moral basis to weigh in or deny the president’s limited scope to restore public safety.
In a Nutshell this is what many perceive as the DOJ argument to seek parameters for such declaration.
Essentially one political party has abridged it’s elected mandate for public safety, and to protect lives and property, thus making their role at the federal in jeopardy of becoming moot by their own administration - no longer a legitimate partner by acts.
What actions has Trump take in the past makes you think that he will order tanks down Main Street, USA?
