(San Diego) Protesters rally against stay-at-home order

SAN DIEGO (CNS) – Demonstrators are gathering Saturday to protest the stay-at-home order issued to curb the spread of COVID-19.

Two protests are scheduled for 1 p.m.- one at the Hall of Justice downtown and the other near Balboa Park, at the corner of Sixth Avenue and Laurel Street.

“This event is intended to be nonpartisan, just a group of park lovers, who want to able to use Balboa Park again for relaxation, walking and other exercise,” said Roger Ogden of Bankers Hill.

A local or state government can set aside constitutional rights, Ogden said, if there is a compelling reason to do so, such as imminent danger to others.

“However, we do not believe that the COVID-19 bug represents such an immediate danger to others that constitutional rights should be curtailed,” Ogden said. “Fewer have died this year due to COVID-19, 70 people in San Diego, than died in this year’s flu season, 105 persons.”

Ogden said he talked to some San Diego Police Department officers recently at Balboa Park, and it “sounds like the police may want to cite us if we’re not careful.”

The event organizer said he told neighbors about his plans for the protest and many said they were supportive. He said he’s not sure how many residents will show up, though.

“So, it seems highly unlikely that our small gathering to express our free speech will cause direct harm to anyone, any more than it might due to the flu,” Ogden said.

“They panicked and got into this,” Ogden said, referring to state and local officials issuing stay-at-home restrictions, “and now they don’t want to admit they made a mistake. My constitutional rights overrule these restrictions.”

Also planned is a ‘Freedom Rally’ downtown. Organizers are planning a peaceful protest pushing back on the state’s stay-at-home order.

SDPD officials could not immediately be reached for comment on the protest plans.

On Friday, the San Diego Council’s President Pro Tem, Barbara Bry, called for city and county officials and the scientific community to develop a plan to re-open parks and beaches as soon as the first week of May.

Bry, who is in a run-off election for mayor with state Assemblyman Todd Gloria on Nov. 3, said any plan to reopen parks and beaches should include social distancing and face covering requirements.

“Our parks and beaches play an important role in San Diego life, particularly for our residents who live in dense neighborhoods,” Bry said.

Another rally is planned for Sunday in Encinitas. Surfers and community members plan to gather at Swami’s beach along Coast HWY 101 from 10 a.m. -noon on Sunday, April 19 to protest beach and local trail closures.

I think it would be better if people did not have Trump signs only because they will not care if they think it is only Republican protests.

They can?
They may be able to get away with it, but I can’t find anything in the Constitution that says some mayor or city council can legally do it.

Agree. Some leading Democrats have mentioned that they face big financial problems, due to the economy being shut down.

I heard DeBlasio complain, that he’s facing about a $4 billion deficit, I think? And Cuomo is facing about a $7 billion deficit. And these deficits are due to the economic shutdown, which has dried up tax revenues to state and local governments.

And I’m sure the same is happening across the country. The decline in tax revenues, combined with spending staying the same or increasing, results in deficits.

Every state and many localities have state of emergency laws and ordinances. The constitution grants the states the right to make laws that aren’t expressly delegated to the federal government. Once President Trump declared a National Emergency on COVID-19 on March 13th, most of the states and many cities triggered their own emergency laws and ordinances which give officials extraordinary powers to act. Once President Trump lifts the National Emergency proclamation, most states, counties and cities will do the same thing.

Our California Property Taxes (1/2) were due the 11th of April, and we paid those. We have a lot of control on where and how our property taxes are paid.

We will not pay our Fed and State Income taxes until the last minute they are due!
