It would certainly appear to be absurd, but we have probably not seen the raw evidence, the applicable statutes, and the legal analysis of the likely outcome of a prosecution. The IG function is to remedy adminstrative errors and recommend adminstrative actions against employees. If they want to recommend legal action, it has to go to the DOJ who use a very different filter through the same facts. I don't think that we know why they reached their conclusion. Speculation is what is going on right now, could be right or could be wrong.
