To me it looks with 3rd degree robbery with assault. The assault should be considered 2nd degree because it was committed during, and instrumental to another felony, the robbery.
2nd degree assault is an offense to which bail can be applied. But I probably don’t read the law like a NY judge or lawmaker.
I would be happy to let this bastard out without posting bail if it was directly back to Jamaica. In the back of a cargo plane where someone could tattoo “No re-admittance” on his forehead.
