I normally am OK with bad results for actual police misconduct, because you ahve to stop that.

But it looks like most of the misconduct was the police not investigating further after they had a DNA match.

ANd there is no indication that the rapist was forced to sign the paper; all he had to do was say he didn’t understand it, and then they would have had to have given him a spanish version of it.

I don’t know why they don’t have spanish versions, but remember that he could also have been columbian, or from some other country, and they all have slightly different languages, and so I guess they could get dinged for whatever one they picked.

It seems amazing to me that we don’t have other ways to collect DNA samples than actually getting them from the perpetrator. Of course, it amazes me that anybody consents voluntarily to DNA samples.

I don't understand why he was given his Miranda rights in Spanish but the interpreter could/would not explain DNA collection in Spanish as well. Must DNA collection be in writing?
Maybe the police will have to start carrying hundreds of forms in different languages so they can protect the public.

I call it a result of bad procedure not misconduct. If they’d have held him down and forced getting a sample perhaps.
