Plenty of activist communist judges around to gleefully throw the book at him, all the way up the appellate level. I might suggest a scoped, high powered pellet rifle from a concealed position at 100+ yards away. If you're at risk for going down for a major felony anyway, may as well do it first class.

Felonies do not go away.
His only hope is to try to get it knocked down to a misdemeanor and plead guilty, or take deferred.
Or go to an Alabama jury, but that risks the felony.
