I thought there were only 35 states which had ratified it by the time of the extended deadline.

The 27th amendment is not relevant--there was never a time limit for ratification in that case (and liberals tried to say it was not valid when it was ratified).

The deadline is in the preamble of the amendment and has never been constitutionally tested.
