Judge tells DOJ to charge McCabe or drop investigation

A judge told federal prosecutors on Monday that they needed to charge former acting FBI Director Andrew McCabe or stop investigating whether he lied to authorities.

Judge Reggie B. Walton said at a hearing that if prosecutors don't make a decision by Nov. 15, he would order the Justice Department to release internal FBI documents connected to McCabe's ouster, The Washington Post reported, citing a court transcript.

“I would send this message to those in positions of authority in the U.S. Attorney’s office and the Justice Department ... that I will not condone further delay,” he reportedly said, adding that the case “is just dragging too long.”

“You all have got to cut and make your decision. It’s not a hard decision, and I think it needs to be made. If it’s not made, I’m going to start ordering the release of information because I think our society, our public does have a right to know what’s going on," said Walton, a George W. Bush appointee who once presided over the Foreign Intelligence Surveillance Court.

The “Trump” DOJ has been playing hot potato with McCabe’s potential indictment for 15 months. It’s reasonable to wrap this up.

Hmmmm.... wrap it up just as Barr and the prosecutors are overseas getting evidence from the genesis of the Trump Russia-Russia-Russia Fraud? That certainly would be convenient for certain politicians and Deep State denizens.

Why is this before a judge if the investigators have not yet filed charges?

McCabe proactively sued right? claiming unfair firing?

I would have thought that they had put together a fairly tight case before letting him go.

What are the government attorneys waiting for?

I thought a Grand Jury was supposed to be determining this. This case is over the release of documents from an FOIA request. How can a Judge order the DOJ to charge someone, if it isn’t even part of the case he’s hearing?

There’s a whole lot more crime at the feet of McCabe than just lying to investigators.

This judge has no business telling DOJ when to close out their investigation as DOJ has not yet brought their indictments against McCabe.

This Judge is associated with McCabe’s frivolous lawsuit for wrongful termination and violation of rights.

McCabe’s connected lawyer provided free of charge by the Obama-Clinton syndicate has chosen this court and its roster of judges as a tool used in the bullying of DOJ investigators.

The syndicate knows where its judges reside. And now we see a public report of this Judge getting hostile with DOJ.

Barr should have his US Attorneys motion to disqualify this judge for interfering in a federal investigation.

I think the judge’s heart is in the right place, but....

Prosecutors don’t want to bring charges. They are just play acting. Pretending to investigate.

And besides - the DOJ will never release documents that will incriminate them.

Ain’t gonna happen.

I’m not so sure.

1) It’s penalizing the prosecution for the defense’s delay tactics.
2) I can’t imagine that it’s any of the judge’s purview.
3) Since when do you place time limits on corruption allegations? Some of these take AGES.

Only if The Hill is screwing the pooch on the reporting does it make any sense. In the article, David Brock’s left-wing attack-dog is using FOIA to sue for information and that “The government has reportedly said it would not release the documents due to their potential effect on law enforcement actions.” Perhaps the issue is that the government only has so much time to charge or not if they seek to keep these documents as government secrets.

That is why I asked if a GJ had to indict some one before they are charged... If so, then one could assume a GJ did just that and the judge wants to know why they aren’t charging him....

or perhaps it is just bad reporting and they meant take the case to the GJ for a vote

Precisely, this is the case filed on behalf of NcCabe for wrongful termination and violation of rights. The judge in his termination case has no business telling DOJ what and when as to their separate investigation.

The headline doesn’t seem to match the article.

This is about a judge keeping documents private while an investigation is in progress.
