This law professor make an argument the case is moot, because NY had corrected the offending language. FWIW, Roe v Wade was moot at the Supreme Court as McCorvey was no longer pregnant. Chances are high this professor approves the court ruling on that moot case.

could at least sometimes stand apart from partisanship

How stupid! Partisanship is why there are so many 5-4 decisions.

5-4 decisions are a joke. If nine supposedly top judges cannot agree about what the law is than it must not be very good law; or they must not be very good judges of it.

The Left is in full-out diaper soiling mode.

They know what’s coming; a string of 5-4 decisions that are averse to their philosophy.

I usually respond before reading the posts of others, but hey 2 posts with virtually the same thought only reinforces the thought of the other who beat me to the punch. 8>)

I’m more excited about the prospect of Trump nominating conservative originalists judges in all of the lower federal courts if he’s re-elected. Less than 1% of the court cases appealed are heard by the Supreme Court. Those lower bench appointments are absolutely critical.

Excellent point.

A bare majority on this court is hardly a decisive mandate.
