Federal judge in New York rules against Trump in sanctuary cities case

A federal judge on Friday ruled against the Trump administration's move to withhold grant funding from law enforcement agencies of so-called sanctuary cities, saying it was illegal and unconstitutional.

Judge Edgardo Ramos, of the U.S. District Court for the Southern District of New York, said the government “did not have lawful authority” to make states alert federal agents when an undocumented immigrant is going to be released from state or local custody and allow federal agents to question immigrants in custody about their legal status in order for states and cities to receive funding.

In his ruling, Ramos blocked the government from enforcing those conditions on New York, New York City and the six states that also challenged the requirements: Connecticut, Massachusetts, New Jersey, Rhode Island, Virginia and Washington.

The challengers had asked Ramos to issue a nationwide injunction, but he said they had not shown that such a move was necessary to afford them relief. He also noted the scope of other district court decisions have been limited.

A district court judge for the Northern District of Illinois issued an injunction blocking the administration from enforcing the conditions nationwide in September 2017. The ruling was affirmed by the Seventh Circuit Court of Appeals, but the court later put its nationwide scope on hold pending a review by the court’s full panel of judges.

A district court in Philadelphia has blocked the administration from enforcing the condition on Philadelphia. The government has appealed that ruling to the Third Circuit. And a district court in California blocked the condition from being enforced on the city and county of San Francisco.

New York Attorney General Barbara Underwood called the court’s decision a major win.

“As we argued, local law enforcement has the right to decide how to meet their local public safety needs – and the Trump administration simply does not have the right to require state and local police to act as federal immigration agents,” she said. “The Trump administration’s attempt to withhold these vital funds was nothing more than a political attack at the expense of our public safety.”

The one thing Sessions should’ve been doing as AG was prosecuting the sanctuary city and state officials for felony harboring illegal aliens. But he didn’t do that because he’s a FRAUD and a BACKSTABBING RAT BASTARD.

lol...we have no conservatives in the Senate. There are 870 fed judges appointed by bush,clinton and O’muslim. Most of those are radical leftists. Even if Trump served all 8 years, he could appoint 300 new judges-maybe. And judging by the Trump appointed Acosta judge[Timothy Kelly], those are not a guarantee

They make law as they wish these days, constitution means nothing, the best way to stop this short of war is no longer listen, when a judge says trump can’t do this , do it make them take it to the SC..to hell with fake laws designed to enslave the people

Given the fact that it is now accepted that they can rule on whether or not any law passed, and by extension regulations put in place in furtherance of such laws, is Constitutional, they surely can make law by leaving a law passed by Congress in place and altering into insanity how regulations implementing that law must be interpreted or eliminated.

If you dictate that regulations enforcing a law must be implemented in a way that is directly opposed to the clear intentions of Congress, that absolutely is "making law".

If that is the case how can states be expected to have their laws concerning speed limits, drinking age, and other things to conform in order to get federal highway money? States that do not conform with federal regulations get threatened with losing highway money. Is that also unconstitutional?

The courts have the power they do today because the executive and legislative branches have ceded it to them. It’s time to take it back. If it isn’t too late.

States are sovereign from the federal bureaucracy or have you forgotten that constitutional fact?

States SHOULD enforce federal law by ordering their forces to work with federal agents - but the fed has no authority over those forces directly and that’s how it should be.

Now if a state doesn’t want to enforce federal law than the fed has every right to withhold funds to the state for its police forces - just as they did with highway funding and speed limit enforcements.
