DOJ reviewing conduct of paralegal who chased Kirstjen Nielsen from restaurant

The Justice Department is reviewing the conduct of an employee who helped chase Homeland Security Secretary Kirstjen Nielsen from a Mexican restaurant on Tuesday, but First Amendment scholars say that she may be immune from workplace consequences.

Allison Hrabar, a Justice Department paralegal specialist and member of the Democratic Socialists of America, helped organize a dozen-person DSA-led contingent that chanted “shame” at Nielsen until she left MXDC Cocina Mexicana.

Hrabar came under intense scrutiny following the downtown D.C. protest, and political opponents demanded that she be fired for protesting Nielsen's role in separating suspected illegal immigrants from their children — a policy President Trump partially reversed Wednesday.

Hrabar told the Washignton Examiner that as of about noon Thursday, she had not been disciplined. Asked if she still had a job, Hrabar said in a text message: “Yes! Currently at a team lunch."

First Amendment scholars say that she may be immune from workplace consequences.

Those 1st Amendment "scholars" are being one-way hypocrites. The restaurant worker may have 1st Amendment protections, but, that worker also violated the DHS secretary's 1st Amendment rights.

If a crime can be determined and it was against a public official, the punishments goes way up. Not sure what it is in DC. As a minimum she should be fired using the president’s recent reforms as justification. Agree I doubt Sleepy has the balls to do it.

Wonder when this is going to be stopped.

Don’t expect the cops to make arrests for stalking, harassment, simple assault, disturbing the peace or any such thing that taxpayers pay them handsomely to do. Unless democrats are the targets. Union solidarity forever.

She has first amendment rights to protest the government. An employee, not an elected official, is not the government. Her conduct IMO constituted a threat. The governing federal statute, 18usc111 requires some form of physical force as distinguished from state laws which make a distinction between assault or battery. There is a simple assault charge in DC, § 22-3571.01, a misdomeanor. So she will not be prosecuted under the federal statute a felony but could charged under the DC code. IMO, she will be charged under neither. IMO, she should face discharge though as her conduct was detrimental to the department and demonstrated poor judgment. As an intern she has little protections and since being a career employee requires a person demonstrate decent judgment, she has no avenue of redress under the first amendment. Lastly, maybe she and PR HOGG can hook up.

“One way”-you got that right. I could google scores of people, working for both private entities and government, who, on their own time, expressed opinions (such as disagreeing with sodomite mirage and other opinions oppositional to leftist cant), and got fired for doing so.

What if restaurant patron would have physically removed the liberal idiots? Who goes to jail? Wouldn’t it be the same as passengers on a plane that retrain a terrorist that was shouting “all i wanna is a snackbar”?
