Absolutely she is.
Amazing how many go with their emotions and follow the leader Ginsberg without knowing the facts.
The Court ignores the question actually presented by
the case before us and instead decides this case on the basis of a newly discovered constitutional right that is not
implicated by what really occurred at petitioner’s trial. I
would base our decision on what really took place, and
under the highly unusual facts of this case, I would affirm
the judgment below.
