On 4/20, Chuck Schumer To Introduce Bill To Decriminalize Marijuana

Senate Minority Leader Chuck Schumer, D-N.Y., plans to introduce legislation on Friday to decriminalize marijuana on the federal level, adding a high-profile advocate in the effort to decriminalize, legalize and normalize marijuana use in America.

Schumer's legislation would remove marijuana from the list of scheduled substances under a 1970 law that classifies marijuana as dangerous as heroin for legal and regulatory purposes. It would establish funding for women- and minority-owned marijuana businesses, require more research on the drug's public health impact, and maintain federal authority to regulate commercial advertising, similar to existing regulations for tobacco and alcohol.

The difference, as I understand it, is that President Trump has said he would support states that want to modify their state laws to legalize maryjane. Schumer’s proposal would nationalize the legalization of maryjane. States would not have a choice with Schumer’s proposal.

Of the two, I would reluctantly support President Trump’s approach.

As a recovering druggie and alcoholic, I am against any law that in any way legalizes any street drug. Things are bad enough as it is.

That unambiguously translates to businesses owned by anyone except for White Men.

I don’t see anywhere that Schumer is proposing a forced legalization on the states.

Do you have a source for that?

CDC keeps lowering pain meds for chronic pain patients, Veterans, and major health and surgery patients, the GOP will LOSE in 2018. You have people committing suicide because they live in Intractable pain, with NO cures for their diseases. Based on BAD Info by Krebs/Klodoney that is a decade old. It’s been debunked many times over, even CATO debunked it. It’s the illegal crap that is the problem with the OD’s. Or Rich idiots who mix dangerous combos to keep gigs like Richard Petty did.

I’m no expert, but it seems like that would be unconstitutional. States have the right to act as they decide under the 10th Amendment.

also the point is that this is a state issue, not federal- it should be up to the people of each state whether they wish to legalize it or not- He isn’t pushing the gov to introduce a bill to legalize it in NY- Yet he wants to take the right away from states to decide and make it federal?

Everything I’ve read says he is proposing making it legal for states to set their own mj policies without fedgov interference. States can still make it illegal at the state level, if that is their choice.

Where are you all getting that this imposes legality at the state level?

Agreed. Even in the era of Wickard and Raich, that would be a bridge too far.

However, that is not what Schumer is proposing. He is proposing what Trump proposed last week- that there should be federal legislation allowing states to set their own policies. Here is Schumer’s tweet =>

“THREAD: It’s official. Today, I am formally announcing my plan to decriminalize marijuana at the federal level. It’s time we allow states, once and for all, to have the power to decide what works best for them.”

States can indeed set their own mj policies. However, it is with the threat of fedgov prosecution if they choose to legalize.

What Trump and Schumer are saying is get fedgov out of the state’s business, regardless of how they choose to regulate mj.

Not so. It leaves the decision to the states, without federal interference.
