Fired Deputy FBI Director Andrew McCabe is quite confident the DOJ Inspector General's referral Thursday to the U.S. Attorney for his criminal prosecution is going nowhere.
"We were advised of the referral within the past few weeks. Although we believe the referral is unjustified, the standard for an IG referral is very low," McCabe's attorney released in a statement Thursday afternoon. "We have already met with staff members from the U.S. Attorneys Office. We are confident that, unless there is inappropriate pressure from high levels of the Administration, the U.S. Attorneys Office will conclude that it should decline to prosecute."
A reminder of the finding from the IG report:
"We found that, in a conversation with then-Director Comey shortly after the WSJ article was published, McCabe lacked candor when he told Comey, or made statements that led Comey to believe, that McCabe had not authorized the disclosure and did not know who did. This conduct violated FBI Offense Code 2.5 (Lack of Candor No Oath).
We also found that on May 9, 2017, when questioned under oath by FBI agents from INSD, McCabe lacked candor when he told the agents that he had not authorized the disclosure to the WSJ and did not know who did. This conduct violated FBI Offense Code 2.6 (Lack of Candor Under Oath)."...

He and his lawyer know there are charges coming and are trying to undermine the prosecution. The tweets from the President will be touted a proof of undue influence. It will all hinge on which judge he gets. DOJ should cut him a deal to ensure a felony conviction and deny him his pension.
So, he knows he will get prosecuted but will blame it on pressure from Trump. Nice try moron.

The whole situation in DC stinks.
This is the very reason why small government is the best government.

Here is McCabe saying right out that he is above the law, and that US Attorney is a deep state protector. What McCabe did is no small crime as laid out in the IG report.
What’s more is that I don’t think the IG is done with McCabe. I expect more when the more extensive report on other issues and persons comes out next month. Remember that this current report only dealt with a media leak, and McCabe’s attempt to cover it up and even blame others. This was not even being looked into originally by the OIG. It was turned over to the OIG as an already ongoing investigation.
I believe that what is coming next is going to make this look like a jay walking offense.

And how does McCabe feel about Comey admitting it was he, who initiated the investigation into McCabe?

Perhaps these referrals deserve a year-long investigation that includes surprise midnight raids of the accused’s friends, family members, and personal attorneys.
Last time I checked, lying to the FBI is a felony, right? How is it they can justify prosecuting Flynn but not McCabe???
Well it’s a broader category which the FBI uses for its personnel — it includes lying and direct forms of deception, of course, but it also includes failing to volunteer relevant info to a superior or investigator even if not asked the question.
That is, the FBI agents and officials are supposed to meet a HIGHER standard than simply “Thou shalt not lie” — they must ensure that superiors or investigators receive all RELEVANT info whether or not they have asked for it.
McCabe told explicit lies, for sure, but he also practiced other forms of evasion and concealment. That is relevant to why he was finally fired by the FBI.
