Pharmacist who claimed self-defense seeks sentence reduction

A former Oklahoma pharmacist is seeking a reduction of the life prison sentence he received for shooting a teenage would-be robber to death nine years ago, but legal experts say actions that many consider vigilantism leave little chance the request will be granted.

What this pharmacist did to an ACTIVE robber-in-the-act would have rightly been shrugged off past a single generation ago. A felon signs his OWN death warrant when he commits violent crimes.

This pharmacist would have been a righteous hero had he stopped at the first shot. But coming back later to empty his gun into the unarmed downed teenager made him a monster. No slack for him....none.

IIRC, this was the guy that didn’t just shoot the robber but once the robber was down and no longer resisting, he executed him - which is a big no-no legally. In Oklahoma, you are only allowed to shoot until the threat stops or you recover your property/they drop it.

I could be wrong about the case, though.

If it is part of the same episode, which this was, the victim should be allowed some latitude in his decisions under intense trauma. Otherwise, you create the hair-splitting madness of the game of "just how much" force was necessary. 3 grams (okay) or 4 grams (EXCESSIVE!!)

Thomas Sowell once opined about use of force by people defending themselves. He said that people should not be expected to dispense force by the thimbleful out of fear that they might go too far.

Already, leftists are busy defining (for us!) just how much force should be necessary to defend ourselves, proscribing the use of certain firearms as 'too powerful' to warrant their use.

Also by Sowell:
“If you are not prepared to use force to defend civilization, then be prepared to accept barbarism.”

The first shot to the head was with a .45 Long Colt. Depending on the injury, if it would have been fatal, all the subsequent shots would have been abuse of a corpse.

His lawyer also may have, or should have argued "heat of the moment".

1st degree murder is outrageous but a sign of our times unfortunately.

He deserves a medal and a marksmanship trophy.

10 yd head shot with a Taurus Judge on an armed moving target while under stress.

That's good shootin'.

This was an insane conviction the pharmacist In the Heat of the Moment believed that the armed robbers were reaching for a weapon and he continued to defend himself

Innocent victims, ANY victims, who are in the narrow timespan of a violent act such as robbery should be given VERY wide latitude on the amount and type of force used.

It is my understanding that the police were called immediately in this robbery. That in itself indicates that the victim (pharmacist - he doesn’t cease being the victim) fully expected that his actions were justified.

If I recall, the pharmacist used two handguns... after emptying one, he went back behind the counter, got another weapon and unloaded it as well.

He dropped the bad guy with a headshot, chased the other guy outside, then returned, went in the back to get another gun and shot the kid 5 more times as he lay unconscious on the floor. All on camera. As much of a scumbag thug the kid was, after the first shot, it was not self defense, especially considering the kid was unarmed. It was murder. Not likely this guy gets his sentence reduced.
