The Constitution does, it's the Civil Rights Act that doesn't.

About 15 years ago or so, the morons on the USSC said that it was okay for UMich to discriminate against people in grad programs, but not for undergrad programs.

Given that UMich is a public school, and Brown is not, Brown may have more leeway in thumbing its nose at equal protection.
