Breaking: Supreme Court refuses to hear Trump challenge on DACA

The Supreme Court on Monday delivered a blow to the Trump administration by refusing to hear the government's challenge to a lower court ruling that has temporarily blocked the administration from winding down the Obama-era Deferred Action for Childhood Arrivals (DACA) program.

The Department of Justice’s request was rare in that it asked the Supreme Court to jump ahead of the 9th Circuit Court of Appeals in reviewing the case.

The court typically will only bypass an appellate court when there’s an emergency involving foreign affairs, a serious separation of powers concerns or when it has already agreed to hear another case dealing with the same question.

How can a court say an EO can not end..............it was never a law

Bummer.

Everything appears to be stacked against Trump. I imagine he’s wondering why he even bother to try to save the country. He has to fight everyone, even his own party. The only thing with him is we the people.

This essentially means that renewals can continue indefinitely while the case goes through the lower courts (which will take a year or more), and the March 5 deadline goes away.

The issue here isn’t so much DACA as it is the more pressing concern of the judiciary assuming control over the executive, by fiat no less. That’s too important to be ignored.

Sorry for the above I see it took four judges to make the decision. Blood will be on their hands should a terrorist from one of these countries act against the USA.

The Courts had their chance, now it’s time to stick a fork in DACA!

I guess instead of winding it down, they need to just let it expire. A court can’t then extend it. That would be making law of a sort. And overtly so.

No, it’s not dead. The injunction holds, the renewals continue, and the March 5 deadline is no longer.

The decision was unanimous; no dissenting opinions from the court. That decision, though, was whether or not to expedite the hearing to SCOTUS, not on the merits of the case.

No, it’s not dead. The injunction holds, the renewals continue, and the March 5 deadline is no longer.


Courts don’t have the authority to nullify the deadline. Their decision can be ignored.
