Every federal court to consider the issue has said it is a violation of the Fourth Amendment to hold a person - whether an illegal immigrant or not - in jail after they are otherwise free to leave the jail.
In this context, it is jails holding illegals for ICE. The jails are under no legal or statutory obligation to hold the person unless ICE gets a warrant for further detention.

Yet ICE is free to detain citizens at a POE without a warrant. Why is that?
So the Fourth Amendment, just like the Fourteenth, has been unconstitutionally “altered” so that it applies to anyone lucky enough to gain entry to our country!
