What’s the crime, the old one, we don’t prosecute anymore but should?

Sedition, I think. The FBI and Secret Service need to pay a visit to Ellison.

You’re probably thinking of treason. Sedition isn’t charged often, but is on occasion. I believe the last conviction was the blind sheikh. Before that, I think some of the later pardoned FALN terrorists were convicted of sedition. Seditious speech is difficult, unless the threat is imminent. That’s pursuant to a court ruling so could be changed. Seditious acts, prosecution for the acts is easier.
