A prominent U.S. appeals court judge announced his retirement Monday days after women alleged he subjected them to inappropriate sexual conduct or comments.
Judge Alex Kozinski of the 9th U.S. Circuit Court of Appeals said in a statement that a battle over the accusations would not be good for the judiciary. He said he'll step down, effective immediately.
The Washington Post reported last week that at least 15 women made allegations against Kozinski that go back decades. The allegations include inappropriate touching and lewd comments.
Kozinski said while speaking in a "candid way" with male and female law clerks, "I may not have been mindful enough of the special challenges and pressures that women face in the workplace," the statement said. "It grieves me to learn that I caused any of my clerks to feel uncomfortable; this was never my intent. For this I sincerely apologize."
Leah Litman, a law professor at the University of California, Irvine, told the Post that the judge talked about having just had sex and pinched her side and leg at a restaurant the night before they appeared together on a panel at her school in July.
Christine Miller, a retired U.S. Court of Federal Claims judge, said Kozinski grabbed her breasts during a car ride in 1986 after a legal community function in the Baltimore area. She said it came after she declined his offer to go to a motel and have sex.
A lawyer who was not identified said Kozinski approached her when she was alone at a legal event in Los Angeles in 2008 and kissed her on the lips and gave her a bear hug with no warning.

He’s not going to put someone better in that slot. This was a very smart man, but very foolish. His actions are going to hurt our country, but depriving them of one of the last conservative judges.

I think that at times men do things, when they don’t fully grasp how they’ll be seen by others.
That’s not meant to be an excuse, because there is no excuse for these things.
Here’s a guy with a very well paid impactful position, and he tossed it all away for utter nonsense.
That’s not to downplay his offense. The behavior is unacceptable and very bad.
He was a Ronald Reagan appointee and was part of the 9th Circuit's small conservative bloc.

They never list the actual ‘inappropriate’ offenses. Likely most would be considered meaningless by most people - including women - when they occurred, or probably even by today’s warped standards.
And this guy was one of the good guys, even though on 9th Circus.
FWIW, he actually wrote some fairly famous dissents from the rulings from the 9th's majority. However, some of the reasons for his dissents are kinda .... awkward.
Nickcarraway will have to answer for himself, but there are some Conservative judges on the Ninth Circuit Court of Appeals. They’re just in the minority, and don’t prevail.
This guy may have been a Constitutionalist judge. I don’t really know.

It refers to him as a Conservative.
Of note, it also says, “Judge Stephen Reinhardt, considered the most liberal jurist on the 9th Circuit, called Kozinski’s retirement ‘a great loss to the court.’”
In another place it references the two judges in the following manner.
“Reinhardt and Kozinski were dubbed ‘the odd couple’ many years ago because they were friends, despite coming from opposite ends of the political spectrum and often penning dueling rulings and commentary.”
I’m sorry, but their were never many judge like Kozinski, and there are fewer and fewer. There are less and less conservative judges, but especially of his caliber. These were rash and reckless acts by him.

I doubt it also, but we may be surprised.
Was he the Chief Justice of that court?
According to the article that makes five openings on that court. 17 of 25 of the judges have been Democrat appointments. Almost certainly the others have been RINO appointments.

I think a good rule of thumb is to ask “would Bill Clinton or Joe Biden think this is appropriate?”
If the answer is “yes”, then DON’T DO THAT!
One down in the 9th circuit, chalk one up for Trump.
This is an opportunity for President Trump to place a young solid conservative on the 9th Circuit Court to replace a conservative, but age 67, judge. Remember, the war to improve the 9th Circuit is a LONG-TERM effort. One judge will not make an immediate difference but as more good constitutionalists are added to that court we will see positive changes.
