The Shaver case is well beyond politics. There is nothing conservative, liberal or constitutional about an agent of the state killing an American without just cause. It is deeply wrong regardless of party or ideology. Bernie Sanders voters and the most ardent Trump supporters all should be united in outrage over the death of Daniel Shaver.

Maricopa County District Attorney Bill Montgomery got it right by charging Brailsford with second degree murder. The jury got it very wrong. Shaver should be alive, and his death must be taken as a call to action. Police departments should establish that a suspect always has the ability to show hands and lie down on the ground for arrest. Complicated law enforcement commands that require mobility and balance — under threat of execution — cannot be an acceptable standard.

When good faith efforts to respond to police commands can be met with a hail of bullets, we are all in jeopardy, and the work of all law enforcement officers becomes more difficult and dangerous.

That video will be played in civil court.

did the jury see the video ? it was made to sound that the video wasn’t released until after the jury verdict.


Not all the video was shown until AFTER the trial...What a travesty!

As per wikipedia:

Shaver’s wife and her lawyer requested that the Mesa Police Department release bodycam footage of the event.[citation needed] The request for the bodycam footage was initially refused. In a recording released by Shaver’s wife, purportedly of a meeting between her and Maricopa County prosecutors, she was told that she could watch the video only if she agreed not to discuss its contents with the press.[2] Prosecutors and defense attorneys in Brailsford’s murder trial asked that the bodycam footage be sealed. Maricopa County Superior Court Judge Sam Myers granted the motion to seal the footage.[10]

On May 25, 2016, Myers ordered portions of the video released. The released video omits the shooting itself. The edited version includes footage from Brailsford’s body camera up to the time when someone exits Shaver’s hotel room and footage from another officer’s camera while he escorts a woman from the hotel. The footage shows that Shaver was on the floor as ordered and crying when he was shot five times in the back with an AR-15 rifle by Brailsford.[11][12][13][14]

The full unedited body camera footage of the shooting was unsealed by the Court immediately after the end of the trial.

yeah the crossed leg thing was impossible- but the key i think was having the hands straight up in air- with clear introductions not to drop the hands for any reason

The whole reason for having them crawl was to get them away from the hidden door where the officers didn’t know if there was anyone else or not

Never said they were under control- many cops aren’t in what could be a very dangerous situation like that- police put their lives on the lien every day all across the country- many don’t make it home at night

What I didn’t understand is why didn’t they tell the guy to stay down on the floor and have the second cop approach him while his hands were stretched out in front of him on the floor?

It was blatantly obvious that this guy was totally wasted and unable to fully heed the commands of the officer.

“HOWEVER, having said that- the cop probably should have said “Keep your hands in the air at all times and knee walk towards me like you wife just did- and as long as you do NOT drop your hands for ANY reason- you will come out of this alive and well”

whatever- Yes- thankfully he did get to go home that night alive- many cops don’t in such situations exactly like that where the perp DOES have a gun

His instructions were clear enough- whether he was screaming or not is irrelevant

We also cannot disregard the obvious terror and panic that Shaver displayed. He begged police “please do not shoot me” and was audibly crying. Everything about the surrounding circumstances showed that Shaver, a husband and father of two young children, just wanted to get out of that hallway with his life. Shaver’s tone and body language were in no way threatening. The officers responded to him with delusional ferocity anyway.

That Brailsford was carrying an AR-15 with “You’re F-—ed” etched into the weapon is a major indicator that he has some very deep-seated issues and should never have been given a badge or a gun.

Simply put, the Shaver shooting was an execution video. This is not about politics. Any moral, law-abiding American should be furious at what happened to Daniel Shaver.


So sad! So frightening :( I have almost always give police benefit of the doubt...not this time and maybe should rethink in future :(

It is not unimaginable to me that under certain circumstances—too much celebrating at a wedding for example—any of my family or friends, law-abiding good citizens, could be in a situation like Shavers—Truly a “being in wrong place at wrong time with the wrong cop”...

Yep, instead of posting article after article on the same subject, day after day, with nothing new being said, these people need to start their own country and regulate the police in the way they see fit. Most of them are Libertarians who have been threatening to start their own state for decades but they never seem able to do it.

They are great at bitching and moaning about the imperfection of functioning states, though.

You're interpretation of the whole event is poor. The cop, evaluated with poor job performance ratings, ordered Shaver to crawl on his knees with his legs crossed. You try it. Shaver had underwear that he was losing. So, again, you try crawling on your knees with your underwear falling down. Terrified, Shaver reached to pull up his underwear. That's very clear from the video. He was trying to comply with the officer's orders.

Further, a department investigator, not named in news accounts that I have seen, said that he saw no reason that the officers could not have simply walked over and handcuffed Shaver.

It is clear. The cop was looking for an excuse to execute shaver. He got it, and he shot and killed him.

Murder. Pure and simple.

I have rheumatoid arthritis and I could not have done that: neither in reference to the knees nor the arms.

As soon a he was down and had his arms out, he should have been cuffed, and that's the end of it. This was murder. M U R D E R.

But at least something should be in the hand yes?

Otherwise, with your reasoning, if a cop approaches and your hands are not in view, when he asks you to show them, when you do, since there could be a gun in it, it would justify shooting.

An impossible condition to meet.

I thought that too at first- watched video again and it was clear that the cop needed the perp to crawl away from the door that was behind him and hidden by a corner
