Mesa Police Shooting: Daniel Shaver Seen Crawling, Degging in Disturbing Video

Brailsford orders Shaver, 26, to lay face-down in a hallway and refrain from making sudden movements - or risk being shot. He also orders a woman in the hallway to lie on the ground. Shaver is seen complying with the officer's order to put his hands on top of his head and cross his left foot over his right foot.

"Young man, you are not to move. You are to put your eyes down look down at the carpet you are to keep your fingers interlaced behind your head you are to keep your feet crossed," Brailsford says. "If you move, we are going to consider that a threat, and we are going to deal with it and you may not survive it, do you understand me?"

"Yes sir," Shaver says.

Brailsford then orders the woman to kneel, put her hands in the air and crawl towards officers. Officers then apparently handcuff her out of the view of the camera.

Have you ever been in situation like that?

Guy reaching into his truck suddenly like that seems pretty threatening to me.

In a combat zone, I’d have shot him, too.

But this is not a combat zone, you say. Or is it? Those are the rules by which the criminals operate. And in the face of that the cops are forced to use Disneyland rules of engagement.

It’s stupid beyond words.

I wasn’t aware that you are so well acquainted with the man in question. Never met him, myself.

I have seen in the last couple of decades, though, that a lot of soldiers and marines go crazy with the ink. It’s too bad, but with tattoos in fashion and young men in combat, it would have been hard to prevent.

Tattoos are no longer the reliable indicator that they once were.

This video is worth watching at 25 minutes long. These cops messed up big time and so did the jury.

They essentially showed up with obviously no tactical plan.

One didn’t bring enough magazines? Really?
Send two team members BACK TO THE FRONT DESK for the keycard?
Didn’t realize they couldn’t be heard in the hallway and had to call the room from the front desk?
Bet they didn’t even run a criminal report on the suspect either. If they had they would have known he was the pest control guy, business license, etc.

Seriously, I do mean seriously watch this video. This team made so many mistakes, including not suspecting the woman was armed and that she was potentially a victim?

Quarterbacking this video? Yep. ‘Cause the police won’t do it themselves.

True. The problem is that the average citizen often gets flustered and confused when dealing with a cop. The cop says “show me your driver’s licence.” And the first thing that pops into the citizen’s head is usually “I’d better get my licence.”

A cop has got to make allowances for that.

Some truth there as well. Society has got to figure out a way that would put neither the cop nor the innocent citizen in an impossible situation.

Too bad. Guarantees of safety aren't in a police officer's job description. He is supposed to protect and serve. First priority is not harming or unduly harassing an innocent person. If that makes the cop less safe, so be it. That's the job. If they don't like it, they can quit.

They wanted to avoid a conviction and a very expensive lawsuit. They’ve only made it worse now. A federal criminal civil rights prosecution will put this POS in prison and exponentially increase the city/PD’s financial liability, This is far from over, I think.

It looked to him like the man was making a move.

dsc, I’ve asked a question like this one elsewhere (I’ve changed it a bit to be more specific). And I am very curious as to what your take on it is.

Consider those shoot-or-don’t-shoot drills police recruits go through. But in this drill the recruit is told he’s clearing a house where a person with a gun has been reported.

A target pops up. The target shows a picture of a man pointing a shotgun. The recruit is supposed to shoot, right?

Another target pops up. It’s a man holding a baby. The recruit is supposed to hold his fire, right?

Now let’s suppose a target pops up of a man with his hand in his pocket. No gun is seen. Should the cop shoot?

I could actually see my hypothetical being presented to a police recruit. It wouldn’t be quite fair, but I could see it happening. After all, such situations do occur in real life.

I was hoping for a less lawyer-like response from you, but that’s OK. It was a tricky question.

It was a wrong question.

For something remotely applicable, one would need a moving suspect. He turns, he identifies you, you see his face change—fight or flight becomes “fight.” His chin stiffens, then he makes a grab for his pocket.

Just seeing someone with his hand in his pocket doesn’t mean a thing.
