Rep. Rokita Unveils Legislation to Jail Local Politicians for Obstructing Immigration Law

Rep. Todd Rokita (R-IN) unveiled the Stopping Lawless Actions of Politicians (SLAP) Act on Monday to impose huge fines and jail state and local politicians who obstruct American immigration law. “The American people are rightfully infuriated watching politicians put their open-borders ideology before the rule of law, and the safety of the people they represent. Politicians don’t get to pick and choose what laws to comply with. Americans are dying because politicians sworn to uphold the law refuse to do so,” Congressman Rokita said. “It’s time the federal government gets serious about enforcing immigration laws and holding politicians accountable who conspire to break them.”

Rep. Rokita’s bill would slap public officials with prison time and large fines should they violate federal immigration law.

We already have laws on the books for harboring illegal aliens. It’s a felony. We just need an AG to start prosecuting these seditious leftists.

I do not think that would be Constitutional.

The Federal government cannot force local government officials to enforce federal law.

They *can* remove federal funds. They have no authority to jail local officials for refusing to enforce federal law.

Don’t local officials swear an oath to obey the laws of the land?

Are they not in violation of their oath for not doing so?

Are they not in violation of federal statutes for not enforcing them?

They are not forced to hold these types of jobs. They can opt out by not running for office.

If they do, they are required to abide by the laws of the nation and in some instance enforce them.

Local Sheriffs certainly do have an obligation to enforce federal law. They are considered to be the top dog in their county.

[2] This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding.

[3] The Senators and Representatives before mentioned, and the Members of the several State Legislatures, and all executive and judicial Officers, both of the United States and of the several States, shall be bound by Oath or Affirmation, to support this Constitution; but no religious Test shall ever be required as a Qualification to any Office or public Trust under the United States

Can you please explain why this doesn't apply.

Agreed, laws exist already that could be used.
Harboring is a felony. Any action to shield an illegal alien from ICE is harboring.

I know that’s unpopular, but you can’t make them spend a dime of their own money without trampling on the 10th Amendment.

And they will argue that even picking up the phone to call ICE when they are releasing someone is encroaching on States rights.

And only congress can remove funds that they have set up. Sessions has little leeway to withhold money,

Section 274 felonies under the federal Immigration and Nationality Act, INA 274A(a)(1)(A):

A person (including a group of persons, business, organization, or local government) commits a federal felony when she or he:

* assists an alien s/he should reasonably know is illegally in the U.S. or who lacks employment authorization, by transporting, sheltering, or assisting him or her to obtain employment, or

* encourages that alien to remain in the U.S. by referring him or her to an employer or by acting as employer or agent for an employer in any way, or

* knowingly assists illegal aliens due to personal convictions.

Just think if we had a real AG...

What is supreme is the Constitution, not the national government. And the Constitution does not require the states to police federal immigration law (see the 10th Amendment), although the states may not nullify or obstruct federal law.

The blue states are in open rebellion. They are providing a foothold for a foreign invasion and subsequent takeover of the United States by mexico.

In a sane world, Trump would have already called out the troops.
