(Meredith) Last year, Justin Havard was convicted and sentenced to eight years in prison for killing an infant in 2013 in Jasper, Texas. Now, hes out of prison after serving just 13 months.
According to KFDM, the Texas Board of Pardons & Parole approved the 27-year-old's release on Thursday.
The situation began in 2013 when Havard called 911, claiming his then-girlfriends three-month-old infant was choking. After the baby died at a Houston hospital, an autopsy was performed, which revealed the baby died from "blunt force trauma to the head," not from choking.
Havard spent two years and 11 months in jail awaiting trial, which counted as time served toward any sentence the jury would hand down.
Jurors had a choice to sentence Havard anywhere from five years to life in prison. Eight years was the final decision.
Havards attorney, Ryan Gertz, predicted Havard would be out in one year since he'd already served three years in jail and was eligible for parole after serving half of his eight-year sentence.
Samantha McDaniel, the mother of Rylan McDaniel, the baby who died, was distraught after learning of Havard's release.
"I got a letter saying that they have agreed to release him and I literally cried from the moment I opened up the letter all the way through the next morning," she told KTRE. "I'm terrified because I go to Walmart and he can be in there. And, what I was told and suggested to do is, just for me, to turn around and leave."
McDaniel told KTRE she and her family are not planning to challenge the probation board's decision.
They must be real confident he’s not going to try to kill everybody inside a church in the next seven years.

I knew of a guy who molested his daughter and was in prison. He was up for parole and the guy’s ex-wife was notified. I wrote a letter for her that simply asked the board “Do you want this guy living next door to your children or grandchildren?”. His parole was denied.
Why? Confinement is confinement.
If you think county jail and prison are the same thing you are wrong.

Actually, I’d not be surprised to learn that prison is less movement-restricted and has better food and recreation than county lockups.

Such a whiner. Sentences don’t start till officially sentenced and hauled off to prison. He was in prison awaiting trial not serving his sentence.

County locks can be the worst facilities. LA County Jail is an example. People go to court to request to be held in State Prison awaiting trial instead of County.
