An 82-year-old Harris County woman is suing Red Lobster, saying the seafood restaurant got her so drunk she fell and broke her hip and arm in the parking lot.
The suit filed in Harris County Monday says that 113-pound Marlene Spencer had a 0.31 blood alcohol level when she walked out of the Red Lobster on Bay Area Boulevard in Webster on or around March 27.
Spencer, who lives at the nearby Brookdale Senior Living at Clear Lake, fell in the parking lot, breaking her right hip and right arm, and hitting her head on the ground, the suit says.
She was then taken to Clear Lake Regional hospital, where she stayed for six days and underwent a total hip replacement, according to the suit.
It was not the first time Spencer or other residents of the senior living center had been over-served at the restaurant, the suit says. Spencers daughter had multiple conversations with the Red Lobster management about over-serving her mother, according to the lawsuit.
This was an ongoing problem that Ms. Spencers daughter tried to quell, but to no avail, the suit says. This has been a recurring problem with multiple Brookdale residents.

Over served? Perhaps the lady purchased and subsequently consumed far too many drinks.

So...the wait staff brought her drinks she did not order and then held her down and used a funnel to get her to ingest the alcoholic drinks? There has to be more to this story.

No win situation. Get cut off at two drinks, sue Red Lobster for age discrimination (or other type, depending on minority qualifications, etc).
Why do I have a feeling there were two drunk people involved.

Get drunk at Red Lobster? She was probably blowing a 2.0 before she arrived.
Ms. Spencer has always been free to dine elsewhere.
The Red Lobster is a public restaurant, not a Day Care facility for fragile elderly people.
If the daughter sees herself as her mom’s advocate or responsible caregiver, then the daughter shares in this outcome by bringing her mom back to this restaurant, over and over, despite their practice of “overserving” serving drinks.
If the mother demanded to patronize this restaurant, then someone should have come with her as a minder or assistant.
This is not the job of the restaurant.
They may get a settlement as ‘go the eff away!” money.
Afterwhich, this restaurant has a right to ask Ms Spencer to never darken their revolving doors again.

There is much that could be said, much that might be said about this lawsuit, bowever gentlemanly manners prevents me.
That kind of blows the law case right there.
Bet the daughter has a piece of paper that says mom can't make decisions when she's out of it.
That makes the daughter responsible if she knows this was going on.
The article doesn't say who the 82 year old was with...you can bet she wasn't alone. Still searching.
I was leaning towards taking the restaurant’s side in this, but this comment changed my mind:

Fact is, we’ve come to a place in our civilization that if you are going to sell alcohol to people for consumption on the premisis, you need to be as aware as a reasonable person would be expected to be of whether or not they should be having another drink. It would be hilarious to have a “response time detector” at the bar and, when asked, you have to use it to prove you are sober enough to have another drink.
I tend to agree. A normal 113 lb woman, particularly one this age, could not get close to a .31 BAC unless they had built up a strong tolerance. Most women this size and age would pass out before they even got to .20 I'd bet that she didn't even look that drunk to the server. Every patrol cop has a story about the DUI suspect they were about to let go after the field sobriety tests until they administered a breath test and the person lit it up like a pinball machine.
They obviously imprisoned her and forced the booze down her throat. Otherwise she got drunk because she chose to drink the alcohol i.e. she made herself drunk.
