The Justice Department says it will not prosecute former IRS executive Lois Lerner for targeting conservative groups during the 2010 and 2012 elections.
In a letter to top Republicans on the House Ways and Means Committee, Assistant Attorney General Kevin Brady said that after a careful review of the case, DOJ will not pursue charges against Lerner, who oversaw the IRS division that reviewed tax exempt organizations.
After this process, the Department determined that reopening the investigation would not be appropriate based on the available evidence, Boyd wrote Texas Rep. Kevin Brady, the chairman of the House Ways and Means Committee, and Illinois Rep. Peter Roskam, the chairman of the subcommittee on tax policy.
In April, Brady and Roskam asked Attorney General Jeff Sessions to review the Lerner case and to consider whether she should be charged with a crime.
Lerner was accused of improperly targeting tea party affiliated groups by denying or stonewalling their applications for tax-exempt status.
Lerner, who has since retired from the IRS, pleaded the Fifth in two separate congressional hearings one in 2013 and another in 2014. In 2014, the Ways and Means Committee referred Lerner to the Obama Justice Department for prosecution. Republicans on the panel accused her of obstructing justice and misleading Congress. The Obama DOJ declined prosecution in 2015.
Brady and Roskam blasted the DOJs latest decision.
This is a terrible decision, Brady said in a statement. It sends the message that the same legal, ethical, and Constitutional standards we all live by do not apply to Washington political appointees who will now have the green light to target Americans for their political beliefs and mislead investigators without ever being held accountable for their lawlessness.

In Washington, D.C., the jury would probably have 12 liberals. The District voted more than 90% for Hillary.
Time for Sessions to resign.
Why does Sessions permit this?
Jeff Sessions supporter, but this is so wrong! The President needs to make sure all involved in the IRS scandal are prosecuted and jailed. We have to be better than the democrats and uphold the law.
“The Justice Department says it will not prosecute former IRS executive Lois Lerner for targeting conservative groups.”
Who is in charge at the Justice Department? Are they being blackmailed or are they coconspirators?
Hello Mr. Secretary. Say something or resign/recuse.
“They would never get a conviction. What jury would not have at least one liberal who would vote against conviction?”
At least put the bastards through the mill and lawyers fees. They don’t have any qualms about going after everyday people who run afoul of some obscure chuckenshit law.
This is not looking good.
So once again all that chest thumping and bravado by Congressional Republicans in hearings demanding answers through their investigations was all a complete sham designed to fool the masses.
Have I mentioned how much I dislike Republicans? Democrats are honest in their foolish evil. Republicans govern through subterfuge. They are just as evil.
The “little guy” in America is being jailed for much less.
I agree but the fact is the prosecutors want spotless conviction records. There is a reason the feds win their criminal cases of something like 80%. They only go after cases that have a high chance of winning.
Oh, those are for you and I, the people who don’t matter.
Patience, hell! Clinton fire all 93 US attorneys immediately after being sworn in. Here we are eight months into Trump’s administration and there has been almost no house cleaning.
There will not. Trump can do some good, here and there, but overturning the Deep State is beyond any one man.
There ya go. No one held accountable, it’s same-same as always.
Perhaps we need to look a little harder at sessions...
Well perhaps it is time for her to experience street justice.
For 8 years (and truly much longer than that), Democrats have had a Get Out of Jail Free card. I thought a Trump Admin would put the Law first.........I hope I am wrong in thinking he is turning his back on those who elected him, just going along to get along.
Trump also fired every U.S. Attorney. The problem is that he has not yet nominated anyone to replace most of them. So nearly all U.S. Attorney's Offices are now being headed by career employees as "Acting U.S. Attorney."
That is not the issue with the Lerner case, however, which was investigated by the main DOJ, not by one of the local U.S. Attorneys.
Why blame congress? They are the ones raising the issue. DOJ is Sessions and Trump. Where does the buck stop?
