Allowing resignations shows no remorse by the corporation
A resignation allows the employer to structure the termination in ways that are more favorable to the company -- and its shareholders. For example, in most cases, a resignation bars the employee from seeking unemployment benefits, and protects the company from wrongful termination and breach of contract claims. In addition, the resignation can be structured so that the employee waives and releases the employer from any and all claims arising under the Civil Rights Act, the Fair Labor Standards Act, Age Discrimination in Employment Act, Equal Pay Act, American's with Disabilities Act, etc.
